About the role:
Widerman Malek is seeking a trademark associate attorney with 3–5 years of experience to join our established Intellectual Property team at our headquarters in Melbourne, Florida.

This role offers the opportunity to handle meaningful trademark prosecution, enforcement, and litigation matters for businesses, entrepreneurs, and brand owners. The successful candidate will manage trademark matters at various stages, communicate directly with clients, and work closely with experienced intellectual property attorneys in a collaborative, team-oriented environment.

This is an in-office position in Melbourne, Florida.

What You'll Do:
  • Manage domestic trademark prosecution matters from clearance through registration
  • Conduct trademark searches and advise clients regarding availability, registrability, and potential risk
  • Prepare and file trademark applications, amendments, statements of use, renewals, and related submissions
  • Respond to USPTO Office Actions and address substantive and procedural issues
  • Advise clients regarding trademark selection, protection, enforcement, and portfolio management
  • Handle trademark opposition and cancellation proceedings before the Trademark Trial and Appeal Board
  • Assist with and manage litigation involving trademarks, copyrights, trade dress, unfair competition, and other intellectual property rights
  • Draft cease-and-desist letters, settlement agreements, coexistence agreements, consent agreements, and related documents
  • Conduct legal research and prepare motions, pleadings, discovery, and other litigation materials
  • Communicate directly with clients regarding strategy, case developments, deadlines, and business objectives
  • Collaborate with attorneys across practice areas to support clients with broader business and intellectual property needs
  • Contribute to client relationship development and business development as your practice grows

What We're Looking For:
  • J.D. from an accredited law school
  • Admission to and good standing with a state bar
  • 3–5 years of trademark prosecution and intellectual property litigation experience
  • Experience responding to USPTO Office Actions and managing trademark portfolios
  • Familiarity with proceedings before the Trademark Trial and Appeal Board
  • Strong legal writing, research, analytical, and communication skills
  • Ability to manage multiple matters, priorities, and deadlines with accuracy
  • Sound judgment and a practical, client-focused approach
  • Ability to work independently while contributing to a collaborative team
