The Senior Counsel's primary focus will be supporting Flexrack by Qcells with legal needs arising in connection with the Flexrack by Qcells team's sale of trackers, the buildout of its manufacturing operation and introduction of new products under the Flexrack by Qcells umbrella. These needs include reviewing, drafting, and effectively negotiating equipment supply agreements, material sourcing and construction contracts related to the manufacturing of the trackers, and such other agreements are occasioned by the operation of Flexrack by Qcells. This position reports to the Managing Counsel, or another management personnel that the President of the Company may designate. This position reports to the Cleveland, OH office but will maintain a hybrid schedule of working out of their home office and the Cleveland, OH office. Working hours are Monday through Friday, from 8:00am to 5:00pm or 9:00am to 6:00pm local time. Overtime and weekend working hours may be required as needed. This position is expected to travel up to 15%. 

Essential Job Function & Responsibilities
  • Regular attendance, in accordance with company's attendance policy and supervisory assignment, is an essential job duty requirement for this position
  • Assist the Flexrack by Qcells team in handling all issues arising during the process of manufacturing and selling solar trackers;
  • Structure, draft, review and effectively negotiate supply Agreements and service and vendor contracts;
  • Provide general legal support to finance, development, sales and operations teams regarding issues in the manufacture and sale of solar trackers;
  • Advise business teams regarding issues that arise during the sale process, including change orders, waivers and force majeure notices, warranty claims, and payment enforcement actions, as necessary;
  • Provide general legal counsel and strategic guidance to senior management;
  • Effectively and efficiently engage and manage outside counsel; and
  • All other duties as assigned by General Counsel or other senior management personnel.

Required Qualifications:
  • 3-6 years of relevant experience
  • Strong background in commercial construction and/or supply contracts
  • Active membership in at least one state bar
  • Top law firm training preferred
  • In-house experience preferred
  • Renewable energy experience required with a focus on construction and procurement agreements
