Duties Description
The Deputy General Counsel for Prosecutions provides legal guidance and oversight to the prosecuting attorneys who handle administrative and housing litigation cases on behalf of the State. This includes ensuring compliance with state laws, supporting policy development, managing legal risk, and guiding the unit in implementing legally sound and operationally efficient procedures. Duties include, but are not limited to:
  • Supervise and ensure that the Director of Housing Litigation and Director of Prosecutions (Directors) administer oversight in compliance with applicable administrative procedure acts (SAEPA, NYCRRA), applicable NYS civil procedure law, the NY Human Rights Law, due process standards, and internal agency rules;
  • Supervise and ensure that the Directors implement litigation strategies and case prioritizations in all administrative and housing litigation matters;
  • Supervise and ensure established case management program to ensure the timely resolution of administrative and housing litigation matters;
  • Review and approve a procedure that ensures the proper reporting of case metrics;
  • Ensure that attorneys receive continuing legal education in particular, civil rights law and ethics;
  • Ensure appropriate delegations of duties while maintaining accountability;
  • Establish and ensure internal prosecutorial guidelines with appropriate discretion for the resolution of cases;
  • Supervise advisory attorney to systemic investigation unit with sound legal and ethical advice into systemic patterns of discrimination.

Minimum Qualifications
Minimum Qualifications:
Law degree from an accredited law school; admission to, and member in good standing of, the New York State Bar; and six years of relevant post-bar experience.
