Job Description and Duties:Join the mission-driven team at the Department of Toxic Substances Control (DTSC) as we work to safeguard California's health and environment. As part of the California Environmental Protection Agency (Cal/EPA), DTSC is dedicated to regulating hazardous waste and overseeing the safe handling, treatment and disposal of toxic substances statewide.
In this role, under the direction of the Assistant Chief Counsel you will serve as a lead subject matter expert on complex procurement, contracting and grant administration. You will act as a strategic legal partner to program leadership providing hands-on counsel from the earliest stages of project planning through contract execution and management. You will navigate novel legal issues and provide consultative guidance to help program staff resolve intricate acquisition challenges ensuring programmatic goals are met within the framework of state laws and policies. As an Attorney IV you will have the opportunity to:
- Provide independent legal support on matters related to the Brownfields and Environmental Restoration Program, including cost recovery
- Serve as lead legal advisor supporting the Site Mitigation and Restoration Program (SMRP), with a specialization on Nation Priorities List Sites, in collaboration with United States Environmental Protection Agency (US EPA) to fix and cleanup disaster areas
- Research legal issues and provide written and oral advice to the Director, Deputy Directors, and Department staff on the interpretation and implementation of statutes and regulations as they pertain to site mitigation and cleanup
- Review documents for legal consistency with federal and state statutory and regulatory requirements, including California Environmental Quality Act (CEQA) compliance
- Draft information requests related to Site history, notice letters, and administrative subpoenas to potentially responsible parties and other persons to compel compliance with Health and Safety code statutes
- Develop legal strategy to enforce cleanup requirements and recover costs consistent with Comprehensive Environmental Response, Compensation, Liability Act (CERCLA) and Resource Conservation and Recovery Act (RCRA), and other federal, state, and local requirements, which may include unusual or emerging areas of law
- Licensed to practice law in the State of California desired
- Experience as an attorney with expertise in statutes and regulations at the state or federal level that impact, are administered by, or are analogous to laws implemented by DTSC
- Experience in conducting or supporting litigation in state or federal courts and/or administrative proceedings
- Experience in providing compliance or site remediation advice that is substantively or circumstantially similar to the advisory work performed by DTSC attorneys
- Experience in briefing decision makers at mid- to high-level positions
- Experience in responding to Public Records Act Requests, Freedom of Information Act Requests, discovery requests, or other related document review and production activities
Working Conditions:
Effective July 1, 2025, specific Bargaining Units and associated Excluded State employees are subject to a salary reduction between 2% - 4.62% in exchange for hours in the Personal Leave Program 2025 (PLP 2025) per month.
