Job Summary:
The Senior Litigation Counsel manages the company's U.S. litigation and dispute portfolio. This role serves as the primary U.S. litigation strategist, partnering with business leaders and cross-functional stakeholders to proactively mitigate risk, manage outside counsel, oversee discovery and trial readiness, and drive consistent, high-quality outcomes aligned to business priorities, patient safety, and regulatory obligations.

This is a role well suited to an ambitious professional, looking for the next step in their career. As a Senior Litigation Counsel, you will be responsible for:
  • Owning the strategy, execution, and reporting for U.S. litigation matters, including product liability, commercial disputes, bankruptcy, automobile and other contested matters.
  • Leading pre-litigation dispute management, including intake and triage of claims and demand letters, early investigation and fact development, preservation/hold assessment, selection of response strategy, and pursuit of early resolution where appropriate.
  • Conducting early case assessment, including liability and damages analysis, venue/jurisdiction considerations, discovery strategy, dispositive motion strategy, and settlement evaluation.
  • Directing and managing outside counsel, including selection, staffing, budgeting, billing discipline, performance management, and application of preferred provider programs and guidelines.
  • Partnering with Quality, Regulatory, Medical/Clinical, R&D, Operations, Compliance, HR, and Commercial teams to ensure litigation positions are consistent with regulatory submissions, quality system documentation, and field actions (e.g., complaints, MDRs, CAPAs, recalls/corrections/removals).
  • Leading discovery governance for U.S. matters, including legal holds, collection strategy, review workflows, privilege analysis, protective orders, expert discovery, and coordination with eDiscovery vendors.
  • Drafting, reviewing, and negotiating litigation-related agreements and instruments (e.g., protective orders, confidentiality stipulations, settlement agreements, releases) in collaboration with internal stakeholders.
  • Managing and coordinating insurance-related activities for assigned matters, including identification of potentially applicable policies, timely notice/tender, coordination with carriers and TPAs, coverage position review (with specialized coverage counsel as needed), and alignment on defense and settlement strategy.
  • Partnering with Finance on reserves, accruals, and reporting for litigated and pre-litigation matters, including insurer reporting requirements where applicable.
  • Developing and presenting clear risk assessments and recommendations to senior leadership, including periodic portfolio updates, reserve discussions, and KPI reporting.
  • Supporting and overseeing responses to subpoenas, government inquiries, and pre-suit claims/dispute resolution processes, as needed.

Required skills to have for success in this role
  • Juris Doctor (J.D.) from an accredited law school.
  • Active bar membership in at least one U.S. jurisdiction and ability to remain in good standing.
  • 10+ years of relevant litigation experience, including significant responsibility managing complex U.S. civil litigation (in-house and/or law firm).
  • Demonstrated experience managing outside counsel, budgets, and multiple matters simultaneously.
  • Strong command of U.S. civil procedure, discovery (including e-discovery), privilege, and motion practice; experience with expert-heavy matters preferred.
  • Proven ability to communicate risk and recommendations to business leaders in clear, practical terms.
  • High integrity, sound judgment, and ability to handle confidential and sensitive information.

Preferred skills to have success in this role
  • Prior in-house litigation management experience within a medical device, pharmaceutical, biotechnology, or other highly regulated life sciences environment.
  • Product liability and/or mass tort experience, including coordination of national counsel and management of repeat-player plaintiffs' firms.
  • Experience partnering with Quality and Regulatory functions and working with quality system records, complaint files, CAPA documentation, and field actions.
  • Experience with FDA-related issues in the context of litigation (e.g., MDR reporting, 510(k)/PMA, adverse event evidence, regulatory communications) in collaboration with Regulatory/Quality teams.
  • Experience with arbitration/mediation and structured settlement programs.
  • Experience implementing litigation metrics, matter management tools, and eBilling systems.

The base pay range for this position is:
$212,730- $265,910
