Your Role & Responsibilities
  • We are looking for a Senior Legal Counsel, North America, to join our team and work with some of the world's best known and loved brands in Beauty and Personal care. The role reports into the Elida Beauty General Counsel.
  • The role will involve giving advice to the business on a broad range of legal matters relating to the development, marketing and sale of Elida Beauty products and brands in North America. With a strong focus on marketing and advertising law, the role also covers all areas of commercial law, including drafting and negotiating of contracts, distribution, e-commerce, terms of trade, competition law, intellectual property law, privacy, regulatory and compliance matters.
  • The Legal Team plays an integral part in the business' risk control processes and works closely with all business functions within Elida Beauty . We aim to protect the business and enable it to win - success to us means striking this balance for the benefit of Elida Beauty.

Key Responsibilities:
  • Provide legal advice and commercial risk analysis to the North American marketing and R&D teams on legality and support for product claims and marketing materials in line with all relevant legal and regulatory laws and guidelines.
  • Provide strategic business advice on regional initiatives and material agreements with customers and suppliers.
  • Advise regional sales teams in connection with relationships with customers, including the implementation of agreements, trade terms and pricing.
  • Manage ad hoc regional litigation.
  • Advise on matters concerning intellectual property, data privacy, ethics and other compliance risks for the North American business.
  • Work with members of the North America leadership team to develop and implement legal strategies, which will enable the growth of the business and effectively manage legal risks.
  • Act as the lead marketing law subject matter expert for the global legal team including:
  • Developing and maintaining risk aligned business processes/policies and best in class training and guidance materials.
  • Advising on high-risk issues in connection with on-line and off-line marketing campaigns (including use of user generated content,third party IP and influencers).
  • Pro-actively coordinatingand defending, in accordance with the business strategy, out-going and in-coming competitive and regulatory challenges.
  • Co-ordinate with General Counsel, Continental Europe to identify competition risks for the North American business.
  • Provide relevant and up to date internal training to the business as part of Elida Beauty's overall compliance framework.
  • Contribute to the development and implementation of globally aligned governance, business processes and corporate policies and guidelines.
  • Contribute to the creation, maintenance and control of legal templates, policies, procedures and good legal governance.
  • Manage relationships and costs spent with preferred regional external legal providers.
  • Collaborate and partner with other members of the Legal Team to ensure a consistent and aligned “One Elida Beauty” approach.

Job Skill Requirements and Experience
  • JD from an accredited law school with 8+ years of general corporate/commercial legal experience required, ideally with experience in both a well-respected law firm and in the legal department of an international FMCG company. Experience in Beauty and Personal care is a plus.
  • Membership of at least one state bar, ideally Texas.
  • Experienceproviding counsel to senior business leaders.
  • Experience working cross-functionally with multiple stakeholders
  • Proven experience in handling marketing-related legal matters in the context of BPC or Pharma products including claims development, media clearances and privacy.
  • Broad-based legal experience supporting a consumer business, including drafting and negotiating a variety of commercial agreements (e.g., procurement, IT services, marketing etc..)
  • Knowledge of competition, privacy and consumer protection laws and regulations.
  • Ability to analyze issues & propose legally and commercially viable solutions.
  • Must be highly motivated with a strong work ethic and an ability to function independently and collaboratively.
  • Exhibits solid judgment, integrity, proactivity and flexibility.
  • Excellent communication and interpersonal skills.
  • Excellent organization, execution and project management skills.
  • Ability to travel if necessary.
