Description:

  • Reporting to the SVP for Litigation, Ethics & Compliance, the Senior Director & Counsel leads a global team of trade compliance professionals and serves as legal advisor on trade compliance issues, with support from outside counsel as necessary.
  • Responsible for driving compliance with import, export, and sanctions laws and regulations in markets where An American Multinational Enterprise Information Technology Company operates.
  • Fully accountable for team operational success, organizational design, budget management, and strategic alignment and integration of activities with other major organizational functions, including but not limited to sales, sales operations, supply chain, and government affairs.
  • Possesses strong business acumen and capable of setting and successfully executing strategic goals and priorities.
  • Capable of thriving and influencing in a highly matrixed environment.
  • Acts as a key advisor to executive management in influencing the strategic direction of the business.

Responsibilities:
  • Sets the strategy for An American Multinational Enterprise Information Technology Company trade compliance organization in alignment with the SVP for Litigation, Ethics & Compliance.
  • Drives initiatives to ensure the company's compliance with trade laws and sanctions.
  • Manages the trade compliance team's development of trade compliance policies, procedures, and controls and periodic audits.
  • Advises business stakeholders on trade-related contractual terms and conditions and due diligence in mergers & acquisitions.
  • Leads complex multidimensional projects or helps drive problem resolution that spans legal, business, and functional boundaries (e.g., cross geographies, subject matter areas, jurisdictions, organizations, and business models).
  • Oversees the alignment of critical resources to high-risk areas based on understanding the strategies and goals of An American Multinational Enterprise Information Technology Company and the Legal Department.
  • Takes full accountability for clients' legal needs by delegating appropriately, mitigating overall legal risk, optimizing operations, and networking effectively to achieve resolution of matters outside of direct subject matter expertise or responsibility.
  • Exerts influence on external industry counsels, policies, and regulatory bodies in area of specialization.
  • Influences strategy and sets policy and direction.

Education and Experience Required:
  • JD or LLB.
  • Meets local legal license requirements, i.e., they are an active member in good standing of the state bar that corresponds to the An American Multinational Enterprise Information Technology Company office they are aligned to.
  • 15+ years relevant legal experience at a law firm or in-house, including at least 10 years with import, export, and sanctions laws and regulations.
  • 5+ years supervisory experience.
  • Candidate must be a U.S. citizen, permanent resident, or have protected status, due to requirements of U.S. export control laws and access to controlled technology.

Knowledge and Skills:
  • Deep expertise with U.S. trade controls, including the Export Administration Regulations (EAR), International Traffic in Arms Regulations (ITAR), sanctions enforced by the Office of Foreign Assets Controls (OFAC), and similar laws and regulations in the EU.
  • Deep expertise with U.S. and non-U.S. customs and import laws and regulations.
  • Expertise and knowledge of trade compliance frameworks in China and India is a plus.
  • Advanced understanding of how to navigate multiple international legal environments.
