The Sr. Director - Counsel - Litigation and Government Investigations role is for an experienced, creative and strategic litigation attorney with impeccable judgment who will be a member of the legal team responsible for non-IP litigation matters and government investigations across the globe. Responsibilities:
  • Set and own strategy for, manage, and provide advice to senior leadership and the business on litigation, investigations, and other high-risk matters in the United States and elsewhere
  • Advise on complex pre-litigation disputes and collaborate with cross-functional legal colleagues to provide practical and thoughtful legal counseling on a variety of business initiatives, emerging risk issues and risk assessments
  • Actively engage with and manage outside counsel, including the strategic use of virtual law firm approach to ensure the best outcomes, development and management of reasonable budgets, and alignment of strategies with internal business priorities
  • Build and maintain relationships with key internal stakeholders
  • Maintain engagement with key external parties and entities, including counterparts at other companies in the industry, key government agencies, and outside counsel network
  • Review, analyze and keep current on litigation developments affecting the pharmaceutical industry​

Basic Qualifications:
  • J.D. degree
  • Active license to practice law in the United States
  • Minimum of 5-7 years of experience as a practicing attorney handling complex litigation and government investigations, including class actions, MDLs, complex arbitrations, and similar legal matters
  • Qualified applicants must be authorized to work in the United States on a full-time basis. An American Pharmaceutical Company will not provide support for or sponsor work authorization and/or visas for this role.

Additional Skills/Preferences:
  • 10-plus years of experience as a practicing attorney handling complex litigation and government investigations
  • Experience managing litigation within the pharmaceutical or other highly regulated industry
  • Experience managing litigation outside the U.S.
  • Good judgment and a meticulous level of attention to detail
  • Excellent written and verbal communication skills
  • Highly motivated and collaborative partner with strong interpersonal skills and the ability to work effectively with team members, other lawyers, and members of management across all levels of the company
  • Demonstrated effectiveness in advising and working with senior leadership
  • Experience with matters involving state and federal healthcare programs (e.g., Medicare, Medicaid, 340B, Federal Supply Schedule), fraud and abuse laws (e.g., AKS, False Claims Act), antitrust, securities, product liability, or complex commercial claims
  • Experience with government agencies
  • Experience providing legal support to corporate risk functions (Ethics & Compliance, Internal Audit, and Risk Management) at or for a global company in a highly regulated industry
  • Experience with crisis management
  • Demonstrated ability to appropriately handle highly confidential information
  • Demonstrated commitment to expand knowledge and adapt to a changing risk landscape
