Description:

Senior Counsel for A Manufacturing Company will join an inclusive and service-oriented team of attorneys and legal professionals and will report to the Assistant General Counsel. This is a broad, often complex and interesting practice with significant opportunities for personal and professional growth.

This role will work directly with executives and associates at all levels of the business, participating in leadership meetings and supporting sales, services, marketing and commercial enabling functions. This critical role will provide comprehensive legal support for A Manufacturing Company commercial operations, focusing on transactions with a diverse range of customers including Group Purchasing Organizations (GPOs), hospitals, and state and government entities. The Senior Commercial Counsel will be a key business partner, advising on complex legal issues, mitigating risk, and ensuring compliance with applicable laws and regulations in a highly regulated industry.

This position is part of the Legal function and will be on-site either in Brea, California or Chaska, Minnesota. We will consider a remote option for highly-qualified candidates.

In this role, you will have the opportunity to:
  • Serve as the strategic business partner to support business objectives and advise on risk mitigation strategies
  • Provide practical, solution-oriented approaches to a broad range of legal issues and risks, and then structure, write and negotiate agreements addressing those issues and risks
  • In partnership with specialist attorneys and other professionals, advise on regulatory, compliance, privacy, and litigation matters
  • Supervise legal professionals and other associates on standard agreements
  • Using Danaher Business System (DBS) concepts, work with legal department colleagues to identify, design and implement continuous process improvement initiatives, such as initiatives to improve the department's client service levels or streamline the department's template agreements.

The essential requirements of the job include:
  • Juris Doctor from an accredited law school and 6+ or more years of commercial law experience in the medical device or life sciences industry, in a law firm and/or corporate legal department
  • Active bar membership in good standing in at least one US jurisdiction
  • Up to 15% of travel to company sites as required
  • It would be a plus if you also possess previous experience in:
  • Experience with healthcare regulation, including: fraud and abuse (e.g., anti-kickback); FDA for medical devices; data use and privacy (e.g., HIPAA, GDPR); and anti-corruption (e.g., FCPA)
  • Experience with software transactions
