Description:
We are a fast-growing global reinsurance speciality company servicing the insurance markets of Lloyd's, Europe and North America.In recent years, we have been expanding our North American operations, which includes integrating an exceptional new legal team.
As a result of this growth, we are seeking an additional hands-on Senior Claims Counsel to report to our U.S. General Counsel and CSE Managing Director. This position will handle and advise on all claim related legal issues on Ceded Reinsurance, Assumed Reinsurance, and Direct claims across various disciplines and territories in line with company claims handling guidelines. You will apply your claims/legal knowledge and experience to proactively manage legal claim issues and disputes through resolution, negotiation, and arbitration. Other key elements of this role will include the review and assessment of coverage issues, policy/contract language as well as LPT and Service agreements.
Responsibilities:
- Partner with and provide legal advice to Claims Department on claims coverage and/or strategy
- Manage outside counsel relative to specific disputed matters on Ceded, Assumed and Direct claims
- Provide LPT and Service Agreement legal review, analysis, and interpretation
- Handle litigation and disputes involving the company through resolution
- Monitor caselaw on coverage issues and advise stakeholders of developments
- Draft and/or review settlement agreements
- Display knowledge of review and analysis of complex coverage and contract issues and understanding of underlying claims
- Help develop and manage panel counsel and assess performance to provide feedback to claims management, particularly with coverage and reinsurance counsel
- Provide technical assistance for the due diligence process for new acquisitions, including the assessment of claims legal-related risks and opportunities, reporting findings within the agreed format and required deadlines.
- Evaluate the merit of affirmative claims and advise on pursuit, including cost benefit analysis
- Collaborate on compliance and regulatory monitoring, development and implementation
- Develop and draft U.S. legal, insurance regulatory and compliance best practices and guidelines
Candidate requirements;
- Minimum of 10+ years of handling insurance and reinsurance-related complex claims matters
- Law degree with relevant insurance/reinsurance experience
- Experience in managing disputes, including managing outside counsel
- Strong understanding of the reinsurance legacy market
- Experience drafting and interpreting legal documents
- Demonstrates ability and flexibility in a dynamic environment
- Exceptional knowledge of key terms and conditions in contracts / policies and general knowledge of key legal position in relevant jurisdictions
- Effective verbal and written communication skills
