The Agency for Persons with Disabilities works in partnership with local communities to support people with developmental disabilities in living, learning, and working in their communities. APD provides critical services and supports for customers with developmental disabilities to reach their full potential. The Agency serves people with spina bifida, autism, Down syndrome, children ages 3-5 at high risk of developmental disabilities, cerebral palsy, Prader-Willi syndrome, Phelan-McDermid syndrome, and intellectual disabilities.

Duties and responsibilities include, but are not limited to, the following:
The attorney in this position will focus on Agency rulemaking. This role requires an in-depth understanding, or the ability to develop such an understanding, of the rulemaking process found in chapter 120, Florida Statutes, and administrative rules with the goal of mastering this practice. This attorney will be responsible for moving proposed rules through the statutory rulemaking process and representing the Agency in any rule challenge under Ch. 120, F.S.

This attorney will be required to track and respond timely to all administrative rules reporting requirements established in chapter 120, administrative rules, or as otherwise mandated.

This attorney will work closely with Agency subject matter experts to analyze, review, and draft new and/or amended rules. Additionally, this role requires a high level of responsiveness to the appropriate Agency staff and is expected to brief them as necessary. The Rulemaking Attorney leads or co-leads internal rule development meetings and conducts rule workshops and rule hearings.

This attorney provides legal representation on a variety of issues to the Agency under the direction of the General Counsel. Timely responds to oral and written requests from Agency personnel as directed by the General Counsel. Legal advice and guidance require careful research, exploration of the underlying facts, and discussions with appropriate staff.

Additionally, this position will require the following:
Conducts legal research, interprets statutes, reviews regulations, rules, and operating procedures as necessary in carrying out duties and responsibilities.

Assists with the development and analysis of proposed legislation, rules, and policies/procedures.

Assists with training Agency staff as needed.

Travels as necessary and performs other duties as assigned.

Demonstrate Skills in:
Willingness and ability to learn and adapt to continually evolving software and technology.

Knowledge of:
  • Knowledge of legal terminology.
  • Knowledge of Florida laws and legal procedure, including administrative procedures and practices.
  • Knowledge and experience with public records and their exemptions, HIPAA, and laws and ethics in government.
  • Knowledge of Microsoft Office software (Outlook, Teams, PowerPoint, Excel, and SharePoint) and Adobe Acrobat.
