Job Description:Foster Garvey PC seeks a partner-level attorney with at least seven years of experience advising clients on FDA regulatory matters to join its Consumer Brands industry group. This role offers the opportunity to help lead and grow the Firm's FDA and consumer products regulatory capabilities while working with clients in the food and beverage, dietary supplement, cosmetics, wellness, and broader consumer products industries.
The successful candidate will join a multidisciplinary team representing consumer brands as well as the investors, lenders and strategic partners that support them. Foster Garvey's Consumer Brands team advises emerging companies, established brands, category disruptors, and private capital clients throughout the lifecycle of their businesses, including formation, commercial arrangements, strategic partnerships, financings, acquisitions, and other liquidity events. This attorney will play a significant role in the continued growth of the Firm's FDA and consumer products regulatory practice.
The attorney will serve as a key advisor to clients on FDA regulatory compliance matters affecting food, beverage, dietary supplement, cosmetics, and other consumer product companies. Responsibilities will include counseling clients on labeling and packaging requirements, advertising and promotional claims, ingredient and product compliance, inspections and enforcement matters, recalls and emerging federal and state regulatory developments. Experience advising clients on matters involving the Consumer Product Safety Commission (CPSC), Federal Trade Commission (FTC) or other regulatory regimes affecting consumer products is a plus.
The position will also involve leading the regulatory aspects of sophisticated financing, investment, and M&A transactions, and working closely with investors, lenders, and operating companies to identify, evaluate, and manage regulatory risk. Experience negotiating and advising on commercial transactions and contracts within the consumer brands and consumer products industries is also a plus, including manufacturing, co-packing, supply, bottling, canning, distribution, brokerage, logistics, warehousing, and fulfillment arrangements. Experience with intellectual property protection, licensing, and other brand-related matters is preferred.

Job Requirements:
The Successful Candidate Will Have:
- At least seven years of significant experience advising clients on FDA regulatory compliance matters, with substantial experience involving food, beverage, dietary supplements, cosmetics, and/or other consumer products;
- Experience advising clients on USDA regulatory compliance matters;
- A portable book of business and demonstrated interest in developing and growing client relationships;
- Experience with CPSC, FTC and related federal or state regulatory matters is a plus;
- Experience negotiating or advising on commercial agreements in the consumer brands or consumer products industries is a plus;
- Experience advising on regulatory issues arising in M&A, financing and investment transactions is a plus;
- Admission to practice law in at least one U.S. jurisdiction, with the ability to become admitted as required in the attorney's office jurisdiction;
- California Bar admission is a plus;
- Strong analytical, writing and communication skills;
- Sound business judgment and a practical, client-focused approach to regulatory counseling;
- Demonstrated interest in business development and practice growth;
- The ability to work collaboratively across practices and offices as well as independently;
- The ability to manage significant responsibilities and multiple matters efficiently; and
- A commitment to responsive and professional client service.
Salary Range:
The annualized salary range for this position is $250,000 to $450,000. Actual pay will be adjusted based on the candidate's relevant experience, location, and other job-related factors permitted by law.
