Kanner & Pintaluga, a dynamic and rapidly growing law firm, handles auto accidents, premise liability, medical malpractice, wrongful death cases, nursing home abuse and first-party home and business property damage throughout the State of Florida.
We are seeking an experienced Plaintiff Bad Faith Attorney to join our Litigation team in Boca Raton, Florida. The ideal candidate will have significant experience in first-party property insurance and/or personal injury bad faith litigation, with the ability to identify, develop, and preserve bad faith and coverage issues from the trial court record through appeal. This role involves collaborating closely with trial teams, handling complex motion practice and post-trial matters, and supporting appellate work as needed—through drafting briefs and memoranda, presenting oral argument when appropriate, and providing strategic guidance on legal and appellate issues.
Key Responsabilities:
- Handle all aspects of bad faith and coverage disputes, including strategic planning, motions practice, and litigation support from pre-suit through trial and post-trial.
- Provide on-site legal trial support to attorneys while they are in the process of trying cases in court.
- Meet with attorneys and review drafts of substantive filings and responses (including summary judgment, post-judgment matters, and related motions).
- Conduct thorough legal research and analyze complex legal issues involving claim-handling practices, insurer conduct, and damages theories unique to bad faith litigation.
- Collaborate with trial attorneys to develop and execute litigation and appellate strategies.
- Collaborate with trial teams on bad faith and coverage issues, including drafting dispositive and post-trial motions, jury instructions, and appellate briefs arising out of bad faith and coverage disputes.
- Develop and execute strategies involving claim-handling practice, insurer conduct, and damages theories unique to bad faith litigation.
- Draft clear, persuasive, and well-reasoned legal briefs, memoranda, and other written advocacy.
- Present oral arguments before state and federal courts, including appellate courts when assigned.
- Stay current on legal developments and changes in Florida appellate and insurance law.
- Mentor and provide guidance to junior attorneys and legal staff.
- Perform other related duties as assigned.
Requirements & Skills:
- Juris Doctor (JD) degree from an accredited law school.
- Active membership in good standing with the Florida Bar.
- Preferred: 5+ years of experience in plaintiff appellate litigation or significant experience with bad faith insurance litigation, especially involving homeowners' and commercial property policies.
- Familiarity with Florida's bad faith statutes and related regulatory framework, and the ability to spot and preserve bad faith issues in the trial and appellate record.
- Strong research, writing, and analytical skills.
- Demonstrated ability to handle multiple cases and deadlines effectively.
- Excellent oral advocacy skills with experience arguing cases before appellate courts.
- Ability to work independently and as part of a collaborative team.
