Description:
Overview:The PIP Arbitration Jr. Attorney will work closely with an experienced PIP attorney to provide assistance with the caseload. They will assist with the responsibility of PIP arbitrations from the time of the submission through the conclusion of the arbitration. The Jr. Attorney will learn to prepare their own submissions and appropriately respond to the Respondent's defenses. The Jr. Attorney may also be responsible for the settlement of PIP arbitrations and arguing the arbitration at the time of the hearing.
Responsibilities:
Arbitrations
- Review and updating of fee schedule for accuracy
- Preparation of pre-hearing and OTP submissions
- Performance of arbitration hearing
- Preparation of post-hearing submissions
- Preparation of Requests for Modification/Clarification and Appeals
- Processing of adjournments and consolidations as necessary
- Request and obtain additional supportive medical records as needed
- Prepare / review fee schedule for accuracy
- Review / present settlement offer
- Negotiate potential settlement with insurance company or attorney
- Obtain authorization as necessary from medical provider
- Complete closing paperwork for settlement
- Review and determine if withdrawal is necessary
- Complete closing paperwork for withdrawal
Qualifications:
- Licensed and in good standing with the NJ & NY Bar.
- Juris Doctor (J.D.) degree from an accredited law school
- Ability to learn to properly update the fee schedule breakdowns of all medical specialties in accordance with the New Jersey Fee Schedule and corresponding regulations (MRI, chiropractic, physical therapy, acupuncture, orthopedic, neurologic, pain management, surgery, ASC, hospital, etc.)
- Ability to learn to independently prepare all submissions and argue arbitration hearings based upon defenses submitted, including preparation of digital exhibits
- Ability to learn to negotiate settlements with insurance adjusters and adversaries
- PIP arbitration experience and ability to summarize medical records is not required, but is a plus.
