Essential Duties and Responsibilities:
Client Counseling & Strategic Advice:
  • Provide legal counsel to clients on a wide array of guardianship and probate issues, including compliance with the Texas Estates Code.
  • Advise clients on legal strategies to effectively accomplish client goals, including capacity-related legal issues, adult and asset protection, estate planning, mental health, and guardianship, probate and elder law.Consistently demonstrate ability to counsel and provide guidance to clientele who are in crisis situations who require calm and competent legal advice and assistance.

Litigation & Dispute Resolution:
  • Represent clients in all phases of guardianship, probate and adult protection litigation, including drafting pleadings, conducting discovery, preparing and arguing motions, and handling hearings, arbitrations, mediations, and trials.
  • Analyze the merits of claims and defenses, assess potential exposure, and develop litigation strategies.
  • Present cases in court before judges and juries in high-stakes or complex guardianship, probate, adult protection, and capacity-related matters.

Administrative Practice:
  • Represent clients before government agencies such as the Texas Department of Family and Protective Services
  • Respond to agency investigations and address institutional barriers to adult protection and care for the elderly and disabled, including Adult Protective Services investigations and advocacy regarding protection of rights of elderly and disabled persons.

Business Development & Client Relations:
  • Build and maintain strong, long-term client relationships through regular contact, responsiveness, and superior service.
  • Actively seek and develop new business opportunities within the guardianship, probate, and elder law areas of practice

Legal Research & Analysis:
  • Research and interpret guardianship, probate, adult protection, elder care, and other statutes, case law, regulations, and administrative decisions.
  • Prepare legal memoranda, opinion letters, and advisory documents analyzing legal implications for clients.

Firm Contributions & Professional Development:
  • Contribute to internal firm development efforts including training, mentoring, and marketing initiatives.
  • Stay current on legal developments by participating in continuing legal education (CLE), industry conferences, and legal associations.
  • Demonstrate consistent commitment to excellence and leadership in the areas of capacity-related advocacy, guardianship law, probate law and elder law locally, statewide and nationally.

Administrative & Compliance Duties:
  • Ensure compliance with firm policies and applicable legal and ethical standards.
  • Accurately record billable hours and manage caseload efficiently and proactively.

Travel Requirements:
Travel as necessary to attend court proceedings, client meetings, depositions, or administrative hearings.

Requirements
Qualifications:
  • Juris Doctor (J.D.) from an accredited law school.
  • Admitted to practice in the State of Texas
  • 2–5 years of experience in probate and guardianship law litigation strongly preferred.
  • Strong oral and written communication skills.
  • Demonstrated ability to manage multiple priorities under tight deadlines.
  • Proficiency in legal research tools (e.g., Westlaw, LexisNexis).

Summary
Position Summary:  We are seeking a dynamic and motivated Associate Attorney to join the Guardianship and Probate Section of our Business Department. This individual will be responsible for handling a broad range of guardianship, probate, adult protection and elder law matters, providing not just strategic advice and representation, but also a compassionate and understanding presence for clients navigating often challenging and emotional situations. In addition to this vital client-facing work, you will actively contribute to the development of the firm's practice in these areas. The ideal candidate will possess excellent litigation, legal research, analytical, and client communication skills, and be adept at managing cases in a fast-paced environment.
