Job Overview:A growing boutique law firm in South Brooklyn is seeking an experienced No-Fault Litigation Attorney to join our team.
This is an excellent opportunity for a motivated attorney with a strong understanding of New York No-Fault litigation, provider collections, motion practice, court appearances, settlement strategy, and the full No-Fault case life cycle. The ideal candidate will be able to manage cases independently, draft persuasive legal submissions, appear in court, negotiate effectively, and contribute meaningfully to a busy and established litigation practice.
We are looking for an attorney who is dependable, detail-oriented, analytical, and capable of handling No-Fault matters from inception through resolution.
Position Overview:
The attorney will be responsible for handling New York No-Fault provider litigation matters, including pleadings, motion practice, discovery disputes, court appearances, settlement negotiations, trial preparation, and case strategy. The position requires strong legal writing, litigation judgment, familiarity with NYSCEF, and the ability to manage a caseload efficiently.
The successful candidate should understand the No-Fault litigation process, including issues involving denials, verification requests, EUOs, IMEs, fee schedule defenses, coverage defenses, declaratory judgments, preclusion, timeliness, medical necessity, exhaustion, workers' compensation priority, and related insurance defenses.
Responsibilities:
- Handling New York No-Fault litigation matters from inception through resolution;
- Drafting pleadings, motions, opposition papers, replies, discovery demands, discovery responses, affirmations, stipulations, settlement correspondence, and trial-related submissions;
- Appearing in Civil Court, District Court, Supreme Court, arbitration-related proceedings, and other litigation settings as needed;
- Arguing motions and conferences involving No-Fault disputes;
- Preparing cases for trial, including review of bills, denials, affidavits, medical records, verification correspondence, EUO/IME documents, payment records, and claim files;
- Conducting legal research and drafting persuasive legal memoranda and written submissions;
- Evaluating liability, coverage, preclusion, timeliness, fee schedule, medical necessity, EUO, IME, exhaustion, and workers' compensation issues;
- Managing discovery disputes and preparing appropriate motion practice;
- Negotiating settlements with insurance carriers and defense counsel;
- Communicating professionally with clients, medical providers, opposing counsel, court personnel, and internal staff;
- Monitoring court deadlines, motion return dates, appearances, settlement deadlines, and judgment-related deadlines;
- Supervising or coordinating with paralegals, legal assistants, and support staff as needed;
- Assisting with client intake, case evaluation, and litigation strategy;
- Performing other litigation and case management duties as assigned.
Required Qualifications:
- Admission to the New York State Bar required;
- Prior experience handling New York No-Fault litigation matters strongly preferred;
- Strong knowledge of the New York No-Fault case life cycle;
- Familiarity with NYSCEF filing and court procedures;
- Strong legal research, writing, drafting, and analytical skills;
- Ability to appear in court and argue motions confidently;
- Ability to manage deadlines and work independently;
- Excellent organizational and time-management skills;
- Strong attention to detail;
- Professional communication and negotiation skills;
- Ability to work in a fast-paced litigation environment.
Preferred Qualifications:
- Experience representing medical providers in No-Fault collections matters;
- Experience with Civil Court and District Court No-Fault litigation;
- Familiarity with New York No-Fault Regulations, Insurance Law, CPLR motion practice, and evidentiary issues;
- Experience drafting summary judgment motions, opposition papers, discovery motions, motions to compel, motions to strike, and judgment-related applications;
- Experience with AAA No-Fault arbitration or arbitration-related litigation;
- Experience handling EUO, IME, verification, fee schedule, medical necessity, coverage, and declaratory judgment issues;
- Trial preparation or trial experience preferred but not required;
- Ability to supervise paralegals and support staff is a plus.
