WSHB is seeking a motivated and skilled Employment Attorney with 3 to 7 years of experience to join our dynamic labor and employment practice. This role offers a unique opportunity to manage cases through the entire legal lifecycle—from initial intake and administrative proceedings before state and federal agencies to high-stakes litigation in state and federal courts.While this position is remote, you must live in a state where WSHB has an office location - no exceptions. The states we are located in include: Alabama, Arizona, California, Colorado, Connecticut, Florida, Georgia, Illinois, Louisiana, Massachusetts, Michigan, Nevada, New Jersey, New York, North Carolina, Oregon, Pennsylvania, Rhode Island, South Carolina, Tennessee, Texas, Virginia and Washington.
Key Responsibilities:
- Pre-Litigation & Agency Advocacy: Handle all aspects of pre-litigation matters, including drafting responses to demand letters, evaluating claim values, and representing clients in charges filed with the EEOC, California's Civil Rights Department (CRD), and the Labor Commissioner.
- Full-Scale Litigation: Lead or assist in litigating harassment, discrimination, retaliation, wrongful termination, and wage-and-hour claims in California State and Federal courts. This includes drafting and arguing high-impact motions, executing comprehensive discovery plans, taking and defending depositions of plaintiffs, expert witnesses and corporate designees.
- Advise & Counsel: Provide “hotline” style advice to HR professionals and executives regarding terminations, leaves of absence, and compliance with the California Labor Code to prevent litigation before it starts.
Qualifications:
- Experience: 3-7 years of California employment defense experience.
- Bar Admission: Active member in good standing with the State Bar of California.
- Skills: Strong “defense-side” instincts – identifying early exit strategies for cases and evaluating potential exposure accurately.
- Academics: Strong academic credentials and excellent technical writing skills are a must.
- Professionalism: Ability to interface with corporate clients and provide sophisticated, business-oriented legal solutions.
