Job Summary:
eDiscovery Counsel manages the Firm's largest, highest profile and most complex discovery and fact development matters. eDiscovery Counsel provides creative and strategic design, consultation and management of projects involving large scale discovery and fact development including, but not limited to, document collection, review, production, deposition, motion and trial support with an emphasis on issues associated with electronically stored information. eDiscovery Counsel uses the highest level of technological acumen and an expert-level ability with major industry tools and processes to manage complex eDiscovery projects.

eDiscovery Counsel is also the Firm's primary resource for innovation of and the establishment of the Firm's standards and best practices for electronic discovery. eDiscovery Counsel educates and trains on eDiscovery education and mentoring to the firm's attorneys, LPS education/mentoring. eDiscovery Counsel also provide consulting on matters primarily handled by others and clients' systems and processes.

Job Functions:
  • Lead and manage major discovery projects and advise on progress.
  • Plan and implement major case organization and early case assessment strategy.
  • Create, track and report on cost estimates and case budget.
  • Guidance regarding discovery vendors, software tools, and budgeting.
  • Design and implement document collection, review, production and privilege logging plan.
  • Develop case team legal hold/preservation strategy, the meet & confer process and protective orders.
  • Design and lead all processes concerning privileged documents.
  • Lead, define and implement deposition and witness preparation support process.
  • Consult regarding technical specs/workflow for eDiscovery.
  • Guidance regarding and implementation of search term construction and testing.
  • Identification of and guidance on non-standard data sources, including mobile devices.
  • Advice and guidance on technical specifications for collection, processing, and production of data.
  • Planning, evaluation and guidance on the use of AI/TAR and other technological tools on large data sets.
  • Lead compliance support teams.
  • Perform other duties as assigned.

Minimum Job Qualifications
  • J.D. degree from a major, accredited law school.
  • Admitted to the CA bar, active and in good standing.
  • Flexibility to work long hours and travel on short notice when needed on behalf of clients and the Firm.
  • A minimum of 10 years of complex litigation experience in a law firm from case inception through trial, or equivalent emphasizing eDiscovery project management.
  • Ability to successfully communicate, manage, organize and prioritize multiple projects, using judgment and stakeholder input to achieve objectives and meet time-sensitive deadlines.
  • Ability to effectively and professionally lead all levels of the organization as well as external stakeholders such as vendors and clients.
  • Ability to maintain the highest level of professionalism, composure and leadership in challenging circumstances.
  • Expert knowledge of relevant case law and legal development related to discovery topics.
  • Highest level of expertise in privilege practices and processes.
  • Highest level of expertise in major industry tools such as Relativity.
  • Ability to establish and provide electronic discovery education, mentoring, standards and best practices to all stakeholders in and outside the firm.
  • Extensive familiarity with the concepts and challenges (technical and practical) of data organization, law practice software applications, both in-house and outsourced, and processes to provide innovation in the firm's electronic discovery practices.
