Director, Sr. Corporate Counsel – Regulatory (Clinical Support)General Purpose of the Job
The Director, Senior Corporate Counsel will be a member of the regulatory team within the Justice League. The individual will provide legal guidance and support to the Company on regulatory and compliance matters related to the development and oversight of clinical operations, with a significant focus on clinical IT systems. Responsibilities will include providing legal review of system requirements and collateral, advising on enhancements and necessary updates, and working closely with the compliance team through their review process. In addition, the role will cover day-to-day review of pharmacy operational matters, nutrition services, clinical teammate and patient-facing collateral, and other initiatives that affect outpatient dialysis centers and related businesses.
This position requires expertise in federal healthcare regulatory laws, including the False Claims Act, the Anti-Kickback Statute, and the Civil Monetary Penalties and Beneficiary Inducement laws and their implementing regulations. The attorney should also have strong regulatory analysis and advocacy skills, familiarity with HIPAA and privacy laws, as well as the ability to provide clear, practical guidance in areas of legal and regulatory uncertainty, balancing risk and business needs where there is no clear legal path.
Essential Duties and Responsibilities:
Serve as legal regulatory counsel and strategic partner to A Healthcare Company, with an emphasis on healthcare laws and regulations. In partnership with other A Healthcare Company attorneys and compliance teammates, assist business clients responsible for clinical initiatives and operations in identifying and resolving legal/regulatory matters. Provide day-to-day legal support for clinical IT systems, including review of requirements and collateral, guidance on enhancements and updates, and collaboration with the compliance team with their system review processes. Support pharmacy, nutrition, and other clinical services as part of ongoing operational matters. Advise on compliance with federal and state healthcare industry laws and regulations. Develop strong working relationships with business clients, as well as legal and compliance partners.
Minimum Qualifications:
- Juris Doctorate degree with a minimum of 6 years' experience in legal practice representing businesses and/or organizations in the healthcare industry.
- At least one state bar admission and in good standing, with the ability to waive into Colorado, if needed.
- Substantial knowledge of the Medicare program and healthcare fraud, waste and abuse laws and regulations.
- Strong state and federal regulatory research and analysis skills, including the ability to address unsettled areas of law and apply nuanced analysis to develop practical, risk-based solutions for the business.
