Job Description and Duties:
Under general direction from the General Counsel and Assistant General Counsels for the Legal Affairs III, Legal, Audits and Charters Branch, the Attorney IV represents A Government Entity, the State Superintendent of Public Instruction (SSPI), and the State Board of Education (SBE) in all litigation in all federal and state courts, and all administrative tribunals including the U.S. Department of Education, the Education Audit Appeals Panel, the California State Personnel Board and the Office of Administrative Hearings. Duties include:
  • Represents the A Government Entity , the SSPI and the SBE, and its members in all litigation in federal and state courts. Handles all facets of complex litigation ranging from motions and discovery through trial. Researches and prepares all written pleadings, arguments, and proposed orders in connection with assigned litigation.
  • Researches and prepares appellate briefs in federal and state appellate courts on behalf of the A Government Entity, the SSPI, and the SBE and its members.
  • Researches and prepares memoranda and opinions upon request of the SBE, the SSPI, and staff of the A Government Entity.
  • Researches and drafts legal advice relating to issues having statewide educational impact.
  • Researches, prepares, and submits amicus curiae briefs on items of significant state and national educational concern to all federal and state appellate courts on behalf of the A Government Entity , the SSPI, and the SBE and its members.
  • Analyzes appellate court decisions and advises the SBE, the SSPI, and the staff of the A Government Entity on the legal impact of the decisions.
  • Represents the A Government Entity, the SSPI, the SBE, and its members in all matters before all administrative tribunals including the United States Department of Education, the Education Audit Appeals Panel, the California State Personnel Board, and the Office of Administrative Hearings.

Special Requirements:
Statement of Qualifications
Interested individuals MUST submit a Statement of Qualifications (SOQ) with their application. Resumes, letters, and other materials do not take the place of the SOQ. The SOQ should have a title of “Statement of Qualifications, Your Name,” be no more than 3 pages, no smaller than 12-point font, and address the following:
  • Experience in handling complex litigation matters before all courts and administrative tribunals, including legal research methods, court procedures, rules of evidence and procedures, and administrative law.
  • Experience in handling complex transactional matters including compliance with State contracting and procurement processes, technology development projects, and data privacy requirements.
  • Experience in developing, analyzing and interpreting statutes, regulations and proposed legislation.
  • Experience in handling complex legal and administrative issues from a request for advice to completion, including identifying and analyzing legal issues and developing and implementing a legal recommendation and/or effective course of action.
  • Experience in providing assistance to a diverse and complex constituency, including the State Board of Education, the State Superintendent of Public Instruction and California Department of Education.

  • Active Membership in The California State Bar
