Duties Description
The Deputy Counsel is responsible for assisting the Counsel in managing the legal function of the organization. The incumbent will be expected to provide short-to medium-term tactical direction and operational oversight. Under the direction of the Counsel, the Deputy Counsel will act as the first assistant to the Counsel and will also manage a portfolio of other programmatic responsibilities while assisting with the supervision of other attorneys assigned to project-specific items including:
  • Administrative and Civil litigation.
  • FOIL process
  • Regulation Development

In addition, the Deputy Counsel will serve in the following capacities for OASAS:
  • Lead on the Inspections/Licensing/Quality Review interagency workgroup
  • Lead on the Enhanced Oversight Workgroup
  • Liaison with the Office of Medicaid Inspector General
  • Work with agency liaison on all external audits
  • Liaison with DOH OHIP on Medicaid initiatives
  • Oversee agency staff on development of procurements and contracts.
  • Represent the agency before the Governor's Behavioral Health Services Advisory Council, the Conference of Local Mental Hygiene Directors (CLMHD), InUnity Alliance, and all other associations doing business with the agency
  • Oversee workgroups within OASAS tasked with policy development and implementation of agency goals
  • Support human resources and labor management work
  • Manage litigation matters for the agency
  • Oversee incident management and patient advocacy units
  • Support OASAS for the Interagency Task Force on Overdose Prevention
  • Act as the primary point of contact during any General Counsel absence
  • Manage legal support for the Opioid Settlement Fund Advisory Board
  • Supervise attorneys, paraprofessionals and support staff in Counsel's Office.

Routine travel including some overnights is required (approximately 15%), occasionally to areas not served by public transportation.

Minimum Qualifications
Law degree from an accredited law school; admission to, and member in good standing of, the New York State Bar; and seven years of relevant post-bar experience.

Relevant preferred experience includes experience in the legal field dealing with issues related to substance use disorder, public health, Medicaid and managed care, human services, social services, grant management, contract management, intergovernmental relations, or government or not-for-profit administration.

The salary range listed for this posting reflects the full range for this graded position, factoring in annual performance advances based on satisfactory annual performance reviews. Candidates with no previous State service will begin at the hiring rate (starting rate of the salary range) listed above, plus any applicable Location Pay/Geographic Pay/Shift Pay differentials.

Promotion salaries are calculated by the NYS Office of the State Comptroller in accordance with NYS Civil Service Law, OSC Payroll rules and regulations, and negotiated union contracts.
