Job Summary:
They City of Coeur d'Alene Prosecutor's office is seeking a Deputy City Attorney to join our team.

The Deputy City Attorney performs professional legal work related to the prosecution of criminal misdemeanors and infractions, attending court for arraignments, pre-trials and court trial conferences, motion hearings, court trials and jury trials, sentencing hearings and other related case activities. The Deputy City Attorney also advises the City on a variety of civil matters as assigned, including researching civil issues, interpreting City Code and representing the City with various organizations and committees. The Deputy City Attorney differs from the Assistant City Attorney by providing more oversight of office support staff and legal interns, working with civil matters and assisting with more complex cases. The position works under the general supervision of a Chief Deputy Attorney, although considerable latitude is provided for the exercise of independent discretion and judgment in legal matters. The position requires a Juris Doctorate degree and a license from the Idaho State Bar, with at least three years of relevant legal and courtroom experience. The work is accomplished primarily in an office and courtroom environment. The Deputy City Attorney may be called upon after regular business hours to prepare and present arrest and search warrants and/or to provide legal advice to police officers.

Examples of Duties:

  • Manages a criminal caseload to prosecute misdemeanor cases and infractions including analyzing facts of the case, reviewing criminal histories and formulating appropriate recommendations for resolution of the cases;
  • Prepares for and attends court hearings which include arraignments, pre-trial conferences, motion hearings, court and jury trials, sentencing and post-conviction proceedings including probation violations;
  • Reviews reports and legal documents, including reviewing police records, analyzing legal issues, reviewing evidence, reviewing criminal histories, preparing case summaries, charging crimes when appropriate and making decision on just case resolutions;
  • Interviews victims and witnesses and prepares witnesses for trial; seeks restitution of victims; directs victims to local supportive resources;
  • Performs legal research in case law, rules of evidence and trial techniques;
  • Prepares trial briefs and legal memoranda using electronic research tools;
  • Reviews public record requests and determines redactions as needed;
  • Negotiates case resolutions;
  • Interprets and provides advice to city departments and staff on City Code;
  • Appears in specialty court;
  • Represents city departments, commissioners, boards, committees as assigned and provides legal advice as needed;
  • Provides legal advice and counsel in civil matters, code violations, appeals and conflict cases for other jurisdictions;
  • Negotiates and represents the City in discussions with opposing counsel on various criminal and civil matters which require discretion and decisions on how to proceed;
  • Conducts legal research and analysis for legal motions and briefs;
  • Reviews case files to ensure staff is properly processing and handling pursuant to established policy and provides adjustment training as needed;
  • Responds to management's, supervisor's, co-workers' and citizens' questions and comments in a courteous, thorough and timely manner;
  • Performs time management and scheduling functions, meets deadlines, and sets project priorities;
  • Maintains strict confidentiality of all matters;
  • Assists other department and City employees as needed or requested.
  • Performs all work duties and activities in accordance with City policies, procedures, and safety practices.

Secondary Duties and Responsibilities:

  • Oversees the work of legal support staff
  • Provides guidance and training to Legal Assistants in preparing documents to be filed with the Court;
  • Provides legal training to the police department and Idaho POST Academy;
  • Researches and prepares appellate briefs;
  • Prepares and presents arrest and search warrants;
  • Provides legal advice to police officers.
  • Performs other duties as assigned.

Minimum Requirements:
  • Graduation from a school of law, accredited by the American Bar Association, with a Juris Doctorate Degree; and
  • Member in good standing with the Idaho State Bar; and
  • At least three (3) years of relevant legal experience, with extensive litigation and courtroom experience; and
  • Ability to pass CJIS and ILETS security background check is required.
