Each of the more than 500 staff who work in the Office of the Attorney General are dedicated to serving all Delawareans with integrity and passion.

The White Collar Crime Unit (WCCU) is part of the Fraud and Consumer Protection Division and is based in New Castle County. DAGs in WCCU prosecute crimes statewide that involve financial misconduct and such other criminal matters assigned by the Division Director. The WCCU also pursues civil actions under the Delaware False Claims and Reporting Act for fraud committed against the government.

Summary Statement

The Delaware Department of Justice is looking for a highly motivated and committed deputy attorney general to join the White Collar Crime Unit to fill its “Wage Theft” DAG vacancy. While the successful candidate will work as a member of the WCCU team on the full range of cases handled by the unit, this position will have primary responsibility for leading the Division's efforts related to labor-related crimes and misconduct.

Essential Functions:
This deputy attorney general, under the guidance of Unit leadership, will decide what cases should be prosecuted, which should be resolved by trial, and will try the cases that are not otherwise resolved. While the WCCU is based in New Castle County, this position will handle criminal matters statewide and travel throughout the state is contemplated. This position will be responsible for leading the Department's initiative focused on labor-related crimes and misconduct. In that role, the DAG will direct the investigation and, when appropriate, prosecution of cases involving worker exploitation and wage theft. The DAG will play an instrumental role in the development of prosecutions brought under the recently enacted statute establishing wage theft as an offense under the Delaware criminal code. In developing this novel area of prosecution, the DAG will be expected to coordinate with peers in other jurisdictions, participate in training to develop proficiency and, in turn, conduct training for investigators and support personnel engaged in this effort.

Additional duties for the DAG would include representing the Unit at meetings involving business crime issues, including with federal counterparts, meeting with referral agencies to address issues in the investigation and prosecution of cases within the Unit's jurisdiction, performing intakes and reviewing cases for prosecution. This DAG will work as part of a team with the other members of the WCCU on the full range of WCCU cases.

Because the WCCU works closely with, and relies upon, our investigative partners throughout the State, the successful candidate must have or be able to develop a good working relationship with other deputy attorneys general, investigative partners, support staff and court personnel.

Job Requirements:
This is a challenging position that provides an opportunity to investigate and litigate a wide range of matters including many large and complex frauds. This deputy attorney general should be able to work independently and meet deadlines. Candidates should have an understanding of all facets of the investigation and litigation of complex criminal matters. The strongest candidates will have substantial felony trial experience, substantial experience handling document-intensive cases involving financial misconduct, and have demonstrated the ability to evaluate criminal cases, to determine resolutions, and to anticipate legal issues. Familiarity with finance, tax, accounting or labor law is helpful, but not a prerequisite. Admission to the Delaware Bar, or a willingness to sit for the next Delaware Bar Exam, is required. We seek an individual with a strong commitment to working in the public interest.
