Essential Duties:
  • Drafting and negotiating franchise, development and ancillary agreements, as well as agreements for the acquisition or divestiture of restaurants
  • Providing franchise compliance legal advice, including drafting default and termination notices, drafting and negotiating workout agreements, temporary licensing agreements and attending to other related enforcement matters
  • Providing legal advice in connection with U.S. franchise sales and ensuring compliance with franchise regulatory requirements, including franchise disclosure, franchise relationship and other relevant laws.
  • Drafting and negotiating real estate agreements, including purchase and sale agreements and lease agreements
  • Providing legal advice to Real Estate, Asset Management and Construction teams on real estate matters, including condemnations, construction and environmental matters
  • Draft and review real estate and franchising policies, including operational policies regulating franchisees
  • Developing training materials and conducting training of franchise and real estate personnel
  • Manage and oversee outside counsel with respect to franchising and real estate litigation.

Qualifications & Skills:
  • Juris Doctor degree from an accredited U.S. law school required
  • Licensed to practice law in Florida or another state
  • Knowledge of real estate law (transactions as well as commercial leasing) required
  • Knowledge of franchise and corporate law preferred
  • 4-8 years of legal experience, with law firm experience required
  • Transactional experience with strong drafting and negotiating skills
  • Strong communication skills
  • Demonstrated ability to work effectively in multi-tasking environment with high volume workload
