This position will be working under the general direction of the Senior Counsel – Insured Litigation and Claims will (1) manage assist with managing “Insured Litigation and Claims” in North America and internationally with a primary focus on auto claims; (2) provide legal support to Environment, Health and Safety division; (3) provide legal support to the risk management team and other departments within the BrandSafway.

Key Responsibilities:
  • Receive and review claim/litigation notices to assess a response and next steps, including collection and preservation of evidence and development of a defense strategy.
  • Collaborate with representatives from the Environmental, Health, and Safety division regarding investigation of incidents.
  • Review, review, respond and object (as necessary) to subpoenas for company records.
  • Support HR regarding legal issues arising from garnishment proceedings.
  • Interface with cross-functional leaders in EHS, HR, and Legal, including specifically the Transportation Safety Manager to reduce vehicle accidents, better manage claims, and drive down costs and exposures.
  • Assist the Senior Counsel for Insured Litigation with the review and response (as appropriate) to contractual and/or insurance tender requests for defense/indemnification by Customers and third parties.
  • Prepare presentations and memoranda for Senior Leadership regarding resolved claims, cost savings, and other legal matters that may affect operations and/or company finances.
  • Place Third Party Administrators, Insurance Brokers and Insurance Carriers on notice of insured litigation and claims and work with same to setup and maintain claim files utilizing electronic management tools such as Riskonnect; RiskTrac; Outlook and Sharepoint.
  • Communicate with Third Party Administrators and company personnel regarding claim resolution for matters that are not in litigation.
  • Independently retain, manage and direct outside counsel and communicate regularly with same regarding claim development. Review and process invoices from outside counsel, experts, and other vendors.
  • Prepare litigation holds and coordinate discovery process between branches/other company personnel and outside counsel.
  • Assist the Senior Counsel for Insured Litigation with technically difficult claims by investigating and gathering information to determine the exposure on the claim; direct claim strategy; and manage claims through well-developed action plans to an appropriate and timely resolution.
  • Attend mediations, settlement conferences, trials, and other proceedings on behalf of the Company.
  • In conjunction with the Senior Counsel for Insured Litigation, manage financials of claims within the insurance program. Evaluate potential exposure, set/update reserves for indemnity and for costs within retention levels.
  • In collaboration with the Senior Counsel for Insured Litigation and the Senior Director - Global Risk Management perform comprehensive internal claim/reserve reviews and claim/reserve reviews with third parties like actuaries, brokers and insurance carriers. Support Senior Director - Global Risk Management as needed for insurance renewals.
  • Assist with reporting to insurers regarding coverage issues and development of lawsuits that may exceed deductible.
  • Receive and review incident reports analyzing potential legal risk of claims and litigation.
  • In conjunction with the Senior Counsel for Insured Litigation, direct the investigation of reported incidents coordinating with EHS and retaining outside counsel and/or experts as appropriate.
  • Provide legal support of Product Issue Resolutions working the Engineering organization.

Qualifications:
  • A Juris Doctorate Degree with active license to practice law in at least one US state.
  • At least 3-5 years of litigation experience, with a preference for experience with commercial lines insurance defense.
  • Understanding of insurance programs, financial reserves, and insurance coverage issues.
  • Comfort and familiarity with RMIS systems, including Riskonnect.
  • Excellent organizational and time management skills for high-volume of activities.
  • Strong oral and written communication skills with ability to convey complex issues in concise manner.
  • Ability to work independently, and with confidential information in an appropriate manner.
  • Ability to meet deadlines and focus on problem-solving, with a sense of urgency.
  • Analytical abilities to review, exercise judgment, and evaluate claims to make sound decisions.
  • Availability to perform job duties outside of standard business hours.
  • Willingness to travel for mediations and other legal proceedings.
