About the Role: eBay's dynamic global Technology, Marketing, & Commercial Contracts Legal team is seeking an enthusiastic Commercial Counsel to join our team in either Salt Lake City, UT or Austin, TX. This hybrid role requires in-office presence at least three days a week. You will immerse yourself in our business, lead contract negotiations, and provide crucial commercial insights that directly influence our strategic direction. This position involves providing legal counseling and collaborating directly with business units to ensure alignment with business goals and objectives.Responsibilities:
- Lead the review and negotiation of diverse commercial agreements, including marketing, software licenses/SaaS, Master Service Agreements, Statements of Work, professional services, and data privacy agreement and office leases (both domestic and international).
- Assess legal risks, offering practical guidance on risk management, policy compliance, and contractual obligations.
- Enhance processes by creating, developing, and managing legal trainings and playbooks.
- Cultivate strong, collaborative relationships with strategic business partners, such as security, privacy, procurement, and finance, to align legal strategies with business goals for cohesive operations.
- Undertake special projects and tasks as needed, addressing unique legal challenges and supporting new business initiatives in a dynamic environment (thriving in ambiguous situations where you will be expected to solve novel, precedent-setting challenges).
- Use AI tools to enhance legal service delivery and identify creative, responsible ways to improve efficiency, quality, and business support, in reviewing, drafting, and redlining agreements, while applying sound legal judgment to validate AI-generated work.
- Experience should include:
- Expertise in commercial contract drafting and negotiating including marketing, software licenses and SaaS agreements.
- Experience with commercial leasing (with a focus on office leasing), including at the international level. Construction experience helpful, specifically AIA Forms and international construction.
- Proficient and comfortable using AI tools with a critical eye, applying sound legal judgment to validate and refine all AI-generated work.
- Proven ability to lead negotiations end-to-end.

Qualifications:
- J.D. degree from an ABA accredited law school (or foreign equivalent) and in good standing with a US state bar.
- 6+ years of relevant experience in commercial transaction (drafting and negotiating), preferably including in-house experience.
- Some travel is required.

The base pay range for this position is expected in the range below:
$111,200 - $190,100
