The Prosecution Services Unit (PSU) is responsible for providing legal services in the regulation of all health care boards and councils. PSU takes administrative action against healthcare practitioners for violations of the licensee's practice act. Incumbent in this position provides management and leadership to the Attorney Supervisors, Attorneys and staff in the Allied Section, within the Office of the General Counsel, Prosecution Services Unit. This position spends the majority of the time engaged in supervisory responsibilities. This includes communicating with, motivating, training, and evaluating employees in addition to planning and directing employees' work. The incumbent has the authority to hire, transfer, suspend, lay off, recall, promote, discharge, assign, reward, or discipline subordinate employees or effectively recommend such action. The incumbent will also be required to develop performance expectations, meet with staff regularly to discuss performance, complete performance reviews, maintain vacation and work schedules, ensuring proper coverage, and complete timesheets.

Your Specific Responsibilities:
  • Manages caseloads by assigning and coordinating work;
  • Oversees quality and timeliness of litigation by triaging and auditing case inventories;
  • Utilizes computer case management system to track employee productivity;
  • Generates, analyzes, and disseminates real-time reporting data to both employees and senior management;
  • Conducts and arranges training to assist attorneys and staff in their assigned duties and responsibilities;
  • Develops and implements efficient procedures for resolving cases;
  • Represents the Department before the boards, probable cause panels and the Division of Administrative Hearings;
  • Personally participates in litigation of high priority cases and issues;
  • Renders legal opinions and advice on handling cases before DOAH;
  • Attends employees' DOAH proceedings to provide logistic and legal support;
  • Cooperates closely with Executive Directors and Board Counsel to promote efficient progression of cases heard at board meetings.
  • Cooperates closely with Bureau of Enforcement to support statewide enforcement operations and targeted enforcement of state statutes and board rules.
  • Assists in identifying and utilizing contracted health care experts to ensure current and accurate information is available during litigation;
  • Requires attorney accountability for submission of timely Daily Activity Reports;
  • Reviews and researches proposed or pending legislation;
  • Responds to inquiries from counsel, the public and other agencies regarding current cases, agency policy and public record requests;

Performs related prosecutorial work such as drafting pleadings, litigating cases before DOAH, preparing and presenting cases before the boards and probable cause panels, etc., as needed.

Other duties as assigned.

Qualifications:
  • Juris Doctorate from a law school accredited by the American Bar Association
  • Membership in the Florida Bar
