The Work You Will Do:
The Office of The General Counsel, Division of Drugs, Devices and Cosmetics Legal Unit, Is Seeking a Highly Motivated Individual Who Is Organized, Possesses Excellent Writing Skills, and Has the Ability to Take Initiative and Build Strong, Productive Relationships. This Position Is Located in Tallahassee, Florida.

This Is a Highly Responsible Position in The Office of The General Counsel. This Position Will Assist the Division in Enforcing Chapter 499, Florida Statutes, to Prevent Fraud, Adulteration, Misbranding, or False Advertising in The Preparation, Manufacture, Repackaging, or Distribution of Medical Drugs, Devices, and Cosmetics in The State of Florida. the Division's Enforcement Actions Help to Safeguard the Public Health and Promote the Public Welfare by Protecting the Public from Injury by Product Use and By Merchandising Deceit Involving Drugs, Devices, and Cosmetics. for This Purpose, Florida Law Is Administered in Conformity with The Federal Food, Drug, and Cosmetic Act and Regulations Issued Thereunder. This Position Will Primarily Be Responsible for The Timely Prosecution of Administrative Cases Targeting Licensed Entities and Unlicensed Entities Alike.

Your Specific Responsibilities:
  • Evaluates Investigative Reports and Evidence.
  • Analyzes Violations of Statutes or Administrative Rules for Regulated Professions and Recommends Appropriate Action.
  • Research/drafts/reviews/amends Pleadings, Complaints, Motions, Dismissal Orders, Consent Orders, Settlement Agreements and Memoranda of Law.
  • Negotiates Settlements.
  • Reviews, Edits, and Evaluates Proposed Rule Packages.
  • Responds to Consumer and Industry Inquiries.
  • Analyzes Bills.
  • Compiles Exhibits.
  • Prepares Witnesses to Testify.
  • Takes and Defends Depositions.
  • Initiates and Responds to Discovery.
  • Prosecutes and Defends Enforcement Actions Before the Division of Administrative Hearings and The Agency's Informal Hearing Officer.
  • Prosecutes and Defends Final Orders, Emergency Suspension Orders, Declaratory Judgments, and Rule Waiver and Variance Decisions.
  • Provides Legal Advice to Division Staff and Other Agency Employees.

Minimum Requirements:
  • Must Have a Valid Driver's License; And
  • Must Be a Member of The Florida Bar in Good Standing; And
  • Must Have at Least One Year of Professional Experience in The Practice of Law.

Preferred:
Must Be a Member of The Florida Bar in Good Standing.
