The New Mexico Department of Transportation (NMDOT) is in charge of the acquisition, design, construction and maintenance of all state roads and NMDOT property and provides technical and financial assistance to local entities in regard to local roads. Additionally, it has some regulatory authority as to motor carriers, commercial trucks, airports and railroad operations in New Mexico. NMDOT's Office of General Counsel drafts contract and other legal documents for the agency, provides legal advice to NMDOT management, represents NMDOT in some judicial and administrative proceedings, and provides assistance to and oversight of contract counsel who represent NMDOT in various matters.
As a valued new employee to NMDOT, you may be eligible to received three (3) days of administrative leave upon your start date. This is applicable to external hires not within the State of New Mexico Government.
Why does the job exist?
This attorney will provide legal guidance to NMDOT's Modal Programs Division, including Transportation Regulation Bureau staff, defend Bureau staff in administrative hearings and defend the NMDOT in appeals of final decisions of administrative hearings in court. This attorney will also provide legal guidance to NMDOT's Strategic Infrastructure Development Division and Executive Projects Office, as well as perform other legal work as assigned.

Ideal Candidate:
The ideal candidate will have preferred education and/or experience in the following areas:
Minimum Qualification:
Juris Doctorate degree from an accredited school of law. Must be licensed as an attorney by the Supreme Court of New Mexico or obtain a limited law license within six (6) months of hire (See Rule 15-304 NMRA). Individuals pursuing the limited law license may not engage in the practice of law until the limited law license has been granted.
Employment Requirements:
Must possess and maintain a valid Driver's License. Must possess and maintain a current Defensive Driving Course certificate from the State of New Mexico or must pass and receive a Defensive Driving Course certificate as a condition of continued employment.
All Attorney classifications must be and remain licensed as an attorney, in good standing, by the Supreme Court of New Mexico, or licensed as an attorney and in good standing by the highest court of another state and eligible pursuant to the limited license provisions (See Rules 15-301.1 and 15-301.2 NMRA).
Working Conditions:
Work is performed in an office setting: late hours, weekends, on-call and callback work may be required. Will be exposed to regular periods of video display terminal and keyboard usage and stressful situations. Travel is required. Possible exposure to irate clientele. Incumbent will work under stress and frequent time constraints.

Bargaining Unit Position:
This position is not covered by a collective bargaining agreement.
- The primary responsibilities of this position will include:
- Providing legal guidance to NMDOT's Modal Programs Division, Strategic Infrastructure Development Division, and Executive Projects Office.
- Defending NMDOT staff in administrative hearings.
- Advising senior management on factual determinations and the application of constitutional, statutory, and regulatory law to disputed matters raised in hearings.
- Defending NMDOT in appeals of final decisions of administrative hearings in court.
- Reviewing agreements between the NMDOT and other entities.
NMDOT staff and management and the State Transportation Commission.
Ideal Candidate:
The ideal candidate will have preferred education and/or experience in the following areas:
- Representation of clients in judicial trials or administrative hearing in which evidence is introduced.
- Providing legal advice to and drafting documents for governmental agencies or entities.
- Ability to work on multiple cases concurrently.
- Administrative hearings and rule-making.
- Legislative bill analysis.
