The New Mexico Department of Transportation (NMDOT) works to provide a safe and efficient transportation system for the traveling public in New Mexico. The NMDOT Office of General Counsel (OGC) provides legal assistance and representation to management and statewide divisions and districts of the agency.
The Office of General Counsel (OGC) serves as in-house counsel for the NMDOT staff and management. The OGC consists of General Counsel, 12 attorney positions, five paralegal positions and a Business Operations Manager. The OGC has four practice groups: Operations and Finance, Right-of-Way, Administration, and Employment and Special Projects.
As a valued new employee to NMDOT, you may be eligible to received three (3) days of administrative leave upon your start date. This is applicable to external hires not within the State of New Mexico Government.
Why does the job exist?
This position provides representation of the Department in eminent domain and right-of-way related litigation matters in state courts, in administrative hearings, and in other practice areas as assigned by the General Counsel. The person filling this position will also provide comprehensive legal advice and counsel to the Department's upper management on right-of-way issues involving utilities, railroads, tribal entities, access control, and environmental law.

Ideal Candidate:
The ideal candidate will have preferred education and/or experience in the following areas:
Minimum Qualification:
Juris Doctorate degree from an accredited school of law. Must be licensed as an attorney by the Supreme Court of New Mexico or qualified to apply for limited practice license.
Employment Requirements:
All Attorney classifications must be and remain licensed as an attorney, in good standing, by the Supreme Court of New Mexico, or licensed as an attorney and in good standing by the highest court of another state and eligible pursuant to the limited license provisions (See Rules 15-301.1 and 15-301.2 NMRA).
Must possess and maintain a valid Driver's License. Must possess and maintain a current Defensive Driving Course certificate from the State of New Mexico or must pass and receive a Defensive Driving Course certificate as a condition of continued employment.
Working Conditions:
Work is performed in an office setting: late hours, weekends, on-call and callback work may be required. Will be exposed to regular periods of video display terminal and keyboard usage and stressful situations. Travel is required. Possible exposure to irate clientele. Incumbent will work under stress and frequent time constraints.

Bargaining Unit Position:

- The primary responsibilities of this position will include:
- Legal research and writing
- Oral presentations at hearings before courts and administrative bodies
- Advises administration on matters of law and policy
- Draft and file legal documents
- Manage large case loads
- NMDOT staff and management
- State Transportation Commission
Ideal Candidate:
The ideal candidate will have preferred education and/or experience in the following areas:
- Legislative bill analysis
- Administrative hearings and rule-making
- State and federal court litigation
- Conducting discovery and interviewing witnesses
- Ability to work on multiple cases concurrently
