The Office of the General Counsel at San Francisco Bay Area Rapid Transit (BART) is seeking a skilled Attorney II or Attorney III to join its legal team. This role offers the opportunity to work on a wide range of legal matters supporting a major public transit agency. The position involves providing practical, strategic legal advice across multiple subject areas, with a primary focus on labor and employment matters, public contracting, and regulatory compliance, while also contributing to broader agency initiatives.
Regular and predictable, in-person attendance is an essential function of this role. Key responsibilities include representing the District in labor arbitrations and advising Labor Relations staff; representing the District in disciplinary hearings and advising Human Resources staff; providing counsel on public contracting and procurement issues; reviewing and advising on California Public Records Act requests; and appearing in court proceedings, including Pitchess motions and restraining orders. The role may also involve work in areas such as real estate, land use, environmental law, energy and utilities, intellectual property, constitutional law, litigation, and inter-agency agreements.
The ideal candidate is a strong legal writer and advocate who can manage diverse assignments and provide clear, practical advice to internal clients. Experience in public agency law, labor relations, employment law, or administrative proceedings is highly desirable. Candidates should demonstrate sound judgment, the ability to handle sensitive matters, and a collaborative approach to working with a wide range of stakeholders.

- Reviews, prepares, and assists in the negotiation of contracts and agreements, including competitive bid construction and procurement contracts, professional services agreements, joint powers and other public agency agreements.
- Works with various District departments on development and implementation of various construction projects, interagency agreements, equipment purchases and professional service agreements.
- Confers with and advises officers and employees of the District on legal questions pertaining to their respective duties, powers, functions and obligations.
- Advises management on a wide variety of labor and employment matters; provides legal support and advice for collective bargaining including drafting, reviewing and interpreting contract language; represents the District in in-person labor arbitrations.
- Prepares and drafts various types of legal correspondence including letters, memos, briefs, pleadings, and opinions regarding settlements and negotiations.
