This position is located in the Insurance Fraud Unit of the South Carolina Department of Insurance.

Job Purpose:
The Insurance Fraud Division is a unit within the South Carolina Department of Insurance that investigates and prosecutes insurance fraud cases referred to the Department and coordinates the Department's fraud enforcement policy. Under general supervision of the Insurance Fraud Division Director, this prosecutor position is responsible for prosecution of insurance fraud cases brought on behalf of the State of South Carolina.

Job Functions:

In consultation with the Insurance Fraud Division Director, vets fraud complaints, determines the actions or charges to be brought against the alleged perpetrator and the punishment to be sought; makes, evaluates, negotiates and receives plea offers; explain the reason and process for certain decisions to victims or their families.
Responsible for prosecution of a range of insurance fraud cases assigned or referred to the Insurance Fraud Division which may include complex, high-profile litigation and other matters that may involve substantial public safety concerns: interviews witnesses, victims, and investigators; presents witnesses, photographs, objects, and other evidence of insurance fraud committed by the accused in court; complies with all rules regulating professional responsibility, including specific rules addressing the prosecutorial function: and produces information and other documents to defendants or their lawyers as requested and required by the laws of the State of South Carolina.
Conducts legal research and prepares or reviews memoranda, discovery requests, motions, responses, indictments warrants, and other court documents.
Oversees or assists investigators, detectives, and other law enforcement while gathering evidence.
May perform other related duties as required.

Knowledge, Skills and Abilities Needed:

Must be able to effectively interpret statutes and rules, applying criminal law to facts and determining the significance of testimony or other items of evidence. The analysis also consists of assessing the credibility of witnesses based on factors such as bias or inconsistency in statements.
Must have the ability to fairly and impartially decide whether and how to prosecute accused persons and avoid ethical lapses such as withholding evidence that may negate guilt, relying on false evidence and mistreating the law or facts.
Must be able to effectively organize and apply the theories, practices and principles of effective management in order to oversee, handle, and prepare multiple cases for trial or plea and manage the caseload of the Insurance Fraud Division.
Must be able to effectively communicate orally and in writing on behalf of the State of South Carolina to effectively advocate on behalf of the State of South Carolina.

Minimum and Additional Requirements:
Applicant must have a juris doctor degree or its equivalent from an accredited law school, be a member of the South Carolina Bar in good standing and satisfy Rule 403 requirements, Applicant must satisfactorily complete a drug screening, credit check, delinquent tax check, attorney grievance check, and SLED background check, Applicant must have 5 or more years of experience as a practicing attorney,

Must be willing to travel in and outside of South Carolina as required and be available on call or after hours.

Preferred Qualifications:
Experience with insurance or criminal law is preferred.
