This is an Administrative Services Attorney at the Nebraska Department of Revenue (DOR).

Under administrative direction, provides professional legal services for the agency involving a complex body of law in the research, administration, and enforcement of the agency's statutory authority and obligations.

Job Duties include:
  • Review, evaluate, negotiate, and litigate contested tax cases through DOR's formal hearing process.
  • Assist the Nebraska Attorney General's office in certain matters involving DOR.
  • Conduct complex and varied research in all areas of taxation and related subject matters.
  • Draft legal documents.
  • Provide legal opinions, advice, and recommendations to DOR staff.
  • Represent DOR as a Creditor in Probate and/or Bankruptcy matters through appointment as a Special Assistant Attorney General.
  • Perform related work as assigned.

Requirements:
Attorney III: Three years of experience as an attorney practicing law and providing legal services such as preparing and trying cases, advising clients, and/or interpreting laws or administrative policies.

Attorney II: One year of experience as an attorney practicing law and providing legal services such as preparing cases, advising clients, and/or interpreting laws or administrative policies.

Attorney I: Graduation from an accredited school of law and admission to the Nebraska Bar.

Preferred: Recent experience in litigation and knowledge of the discovery rules; corporate and individual income tax; state and local tax; bankruptcy litigation; criminal litigation; audit and financial record review and/or experience in Federal and/or State tax research; probate and collection law; administrative law practices; high academic performance; course work with an emphasis in taxation, accounting or auditing.

Other: In accordance with Section 7-101, Nebraska Revised, Reissued Statutes of l943, incumbents in this class must be admitted to the Nebraska Bar. We will consider candidates who will graduate with the minimum qualifications by May of 2024 that are taking the July, 2024 bar exam that will be sworn in during September, 2024. We will also consider candidates admitted to the bar in another jurisdiction eligible to be admitted to the Nebraska Bar by Motion contingent upon them becoming admitted to the Nebraska Bar.

  • Ability to: Prepare & communicate in person and in writing the facts and arguments of a case to persuade others to accept the viewpoint presented; work collaboratively as part of a team; interact collaboratively and respectfully with other attorneys and teammates within DOR, other governmental employees, the public, and representatives of parties involved in a case; formulate legal opinions and recommendations based on legal research and investigations; conduct legal research and investigations; identify critical elements of legal questions or issues; prepare/draft legal documents and forms; interpret and apply statutes, case law, decisions of courts and administrative tribunals, and administrative rules and policies.
