Job Description and Duties:
Under the general direction of the Assistant Chief Counsel and Chief Counsel for the Division of Recycling, the Attorney III will prepare cases and advise and represent the Department in complex administration actions, including hearings and settlement negotiations. The Attorney III will act as liaison between the Department and the Attorney General's Office for civil and criminal proceedings. The Attorney III will be responsible for researching and analyzing state and federal case law, statutes, regulations and procedures associated with the Department's programs, especially the Beverage Container Recycling and Litter Reduction Act and its regulations. The Attorney III will be expected to write briefs, Accusations, memoranda and correspondence on complex and difficult legal matters. The Attorney III will be expected to handle requests under the California Public Records Act. The Attorney III will be expected to review and assist with drafting legislative proposals and rulemaking related to the Beverage Container Recycling and Litter Reduction Act and its regulations. The Attorney III will be expected have excellent written and verbal communications skills, and consistently to treat others with courtesy and respect.

This position may be eligible for hybrid telework under Government Code 14200 for eligible applicants residing in California, subject to the candidate meeting telework eligibility criteria set forth in the CalEPA telework policy and/or future program need. Employees not residing in California are not eligible for telework. Regardless of telework eligibility, all employees may be required to report to the position's designated headquarters location, as indicated on their duty statement, at their own expense. Beginning July 1st, 2026, it is anticipated the position will be office-centered and employees will be expected to report to the office at least four days per week.

  • Experience writing about complex legal issues in a legal memorandum or letter.
  • Experience drafting an administrative or judicial pleading.
