The Starting Salary for This Position Is Limited to $88,119. Salary Offers for The Selected Candidate Are Based on The Candidate's Education and Experience Related to The Position, as Well as Our Agency Budget and Equity.

The Primary Purpose of This Position Is to Provide a Full Range of Legal Services to The Divisions of Health Benefits, Social Services and Aging and Adult Services of The Department of Health and Human Services (“dhhs”).

This Position Is Located in The Public Assistance Section of The Health and Human Services Division of The Nc Department of Justice. This Attorney Provides a Full Range of Legal Services to The Divisions of Health Benefits, Social Services and Aging and Adult Services of The Department of Health and Human Services (“dhhs”). This Position Services a Full Range of Client Needs, Including Litigation in Federal and State Courts, Litigation in The Office of Administrative Hearings and Handling of Appeals Involving Medicaid and Public Assistance Issues in Federal and State Courts. Additionally, This Position Provides Legal Advice Directly to The Client and Assists with Many Different Aspects of The Medicaid Program.

Primary Areas of Litigation Include Defending Actions to Deny, Reduce or Terminate Services for Medicaid Recipients and Defending Actions Challenging Medical Necessity or Eligibility Denials. Duties Include Analysis of Legal Issues and Defenses, Performing Legal Research, Developing Case Strategy, Preparing Pleadings, Legal Memoranda and Briefs, Conducting Discovery, Engaging in Pre- and Post-Trial Motions Practice, Conducting Settlement Negotiations, Preparing and Examining Witnesses (including Expert Witnesses), Preparing Evidence, Conducting Courtroom Litigation, Perfecting Appeals, Preparing Appellate Briefs and Presenting Oral Arguments.

This Position Also Provides General Counsel and Advice to The Division of Health Benefits and Dhhs on Various Issues Such As: Drafting or Revising Medicaid Policies, Rules and Legislation; Recoupment Issues Regarding Substantial Sums of Money Owed to The Medicaid Program; Provider Issues; Interpretation of Various State and Federal Statutes, Rules and Regulations; Level of Service Issues; Denials of Prior Approval; Confidentiality of Medicaid Records and Information; and Preventive Measures to Avoid Future Litigation.

This Position Will Also Perform Such Other Duties as May Be Assigned by The Section Head, Division Head or The Attorney General. This Position Occasionally Requires Travel and Overnight Travel as Part of Its Assigned Duties. This Attorney Will Work on Criminal Briefs as Assigned by The Appellate Section of The Department of Justice.

  • Experience Effectively Preparing an Effective Presentation of The Client's Position Through: The Preparation of Exhibits; a Thorough Review of Case File; Discussions with The Client and Witnesses; and Discussions with The Opposing Counsel or Party.
  • Knowledge of Medicaid and Other Public Assistance Law.
  • Experience Communicating Effectively with Individuals with All Levels of Education and Abilities.

Minimum Education and Experience Requirements:
Licensed to Practice Law by The North Carolina State Bar and One Year of Professional Legal Experience.
