This Attorney 2 position is a great opportunity for a professional committed to advancing consumer protection and public safety for Idahoans.
Examples of Duties:
- Attends and provides legal counsel during scheduled board and commission meetings; monitors board activities and advises the boards and the Division's staff on all legal and related matters;
- Provides authoritative legal advice to boards and the Division's management and staff related to statutory authority and responsibilities, technical, and administrative issues;
- Provides daily legal support to the Division's staff regarding licensing issues, scope of practice, disciplinary jurisdiction, statutory interpretation, and general legal questions from the public;
- Provides presentations and training to the Division's staff and board members relating to public meeting laws and their duties and responsibilities.
- Reviews requests made pursuant to the Idaho Public Records Act and drafts responses to such requests as needed;
- Reviews and recommends changes to statute, rule, policy or procedure for conformity with law;
- Drafts proposed legislation and administrative rules, consistent with the Zero Based Regulation Executive Order;
- Conducts legal research related to administrative law and occupational and professional licensing;
- Drafts contracts and leases and reviews such documents for legality and adequacy;
- Negotiates with state and federal agencies, attorneys, private individuals, and organizations in non-litigation situations;
- Works with board prosecution counsel to coordinate disciplinary procedures, including drafting informal agreements, formal stipulations, orders, and related documents;
- Reviews administrative records and prepares briefs and oral argument in petitions for judicial review to district court and appellate courts;
Minimum Qualifications:
- Current member in good standing of the Idaho State Bar.
- Considerable knowledge of trial procedures and rules of evidence.
- Good knowledge of principles and practices of administrative law.
Experience:
- Conducting legal research and drawing legal conclusions
- Presenting oral argument before a court or hearing officer
- Negotiating legal settlements
- Eliciting information from a wide variety of individuals including hostile witnesses
