Position Summary:
Schneiderman & Sherman, P.C. (SSPC) is seeking an experienced and motivated Associate Litigation Attorney to join our creditors' rights and default servicing practice.

The Associate Litigation Attorney will represent lenders, banks, mortgage servicers, and other financial institutions in a broad range of matters involving judicial foreclosure, contested foreclosure, commercial foreclosure, eviction, title disputes, bankruptcy-related defense matters, collections, and other creditors' rights litigation.

This position will be responsible for managing assigned matters throughout the litigation lifecycle, including developing case strategy, drafting pleadings and dispositive motions, conducting legal research, managing discovery, negotiating resolutions, and appearing in court for hearings, settlement conferences, mediations, oral arguments, and trials.

The attorney will also provide legal guidance to clients and internal teams regarding complex title matters, multi-party disputes, guaranty enforcement, commercial loan structures, bankruptcy implications, and other issues arising in connection with default servicing and asset recovery.

The ideal candidate is a strong legal writer and advocate who is detail-oriented, highly organized, comfortable managing an active litigation caseload, and committed to providing exceptional client service. Knowledge of bankruptcy and its impact on foreclosure and eviction proceedings is preferred; however, prior experience practicing bankruptcy law is not required.

Key Responsibilities:
  • Manage a caseload of contested, litigated, judicial, and commercial foreclosure matters from referral through resolution.
  • Draft and prepare legal documents for filing, including complaints, answers, responsive pleadings, motions, briefs, discovery, dispositive motions, quiet title actions, demand letters, FDCPA-related correspondence, and other litigation documents.
  • Develop and execute litigation strategies for contested and complex matters.
  • Represent clients in court proceedings, including contested hearings, motion hearings, oral arguments, settlement conferences, mediations, and trials.
  • Manage discovery, including drafting and responding to written discovery, reviewing documents, preparing motions, and addressing discovery disputes.
  • Analyze and resolve complex title issues, multi-party disputes, guaranty enforcement matters, and issues involving commercial loan structures.
  • Represent and advise lenders, banks, mortgage servicers, and other financial institution clients regarding foreclosure, eviction, title, bankruptcy-related, collections, and creditors' rights matters.
  • Provide strategic legal counsel and practical recommendations to clients, attorneys, legal assistants, and other members of the firm.
  • Conduct thorough legal research using LexisNexis and other available legal research tools.
  • Monitor relevant court decisions, procedural developments, and legal requirements and provide timely guidance regarding their impact on assigned matters.
  • Ensure all pleadings, filings, appearances, client communications, and other case requirements are completed accurately and within applicable deadlines.
  • Communicate directly with clients regarding case strategy, significant developments, risks, recommendations, and resolution opportunities.
  • Negotiate settlements and other resolutions consistent with client objectives and applicable authority.
  • Work cross-functionally with other attorneys, legal assistants, title professionals, support staff, clients, and external vendors to efficiently move matters toward resolution.
  • Maintain accurate and timely case information, documentation, and reporting within the firm's case management system and applicable client systems.
  • Maintain the highest standards of professionalism, responsiveness, compliance, and client service.
  • Perform other duties and special projects as assigned by supervisor(s).

Required Qualifications & Skills:
  • Juris Doctor (JD) from an accredited law school.
  • Active admission to the State Bar of Michigan and in good standing.
  • Litigation experience with the ability to independently manage assigned matters and court appearances.
  • Knowledge of Michigan court procedures, rules, and filing requirements.
  • Strong legal research, analytical, and problem-solving skills.
  • Excellent legal writing and drafting skills.
  • Strong written and verbal communication skills.
  • Ability to effectively advocate for clients in both written and oral proceedings.
  • Strong organizational and time-management skills with the ability to manage multiple matters, priorities, and deadlines.
  • Ability to work independently while collaborating effectively with attorneys and support teams.
  • Strong attention to detail and commitment to timely, accurate, and compliant work.
  • Commitment to delivering a high level of service to both clients and internal teams.

Preferred Qualifications:
  • 3–5+ years of relevant litigation experience, particularly in foreclosure, default servicing, creditors' rights, commercial litigation, eviction, title, or collections.
  • Prior courtroom experience, including contested hearings and motion practice.
  • Experience managing contested foreclosure and commercial foreclosure matters.
  • Experience drafting and arguing dispositive motions.
  • Experience handling complex title disputes, multi-party litigation, guaranty enforcement, or commercial loan matters.
  • Familiarity with bankruptcy proceedings and the impact of bankruptcy filings on foreclosure, eviction, and creditors' rights matters.
  • Experience reviewing and interpreting statutes, court rules, case law, and regulatory requirements.
  • Experience working directly with banks, mortgage servicers, lenders, or other financial institutions.
  • Prior experience with CaseAware or a similar legal case management system.

What Success Looks Like:
The successful Associate Litigation Attorney will take ownership of assigned matters, proactively develop litigation strategies, meet court and client deadlines, and provide clear and practical legal guidance. This attorney will be comfortable handling both routine creditors' rights litigation and increasingly complex contested matters while knowing when to collaborate or escalate issues.

Success in this role also requires strong communication with clients and internal teams, sound judgment, attention to detail, and a consistent commitment to achieving effective and efficient resolutions while protecting client interests.

Schedule & Work Environment
This is a full-time position, Monday through Friday, 8:30 a.m. to 5:00 p.m., averaging approximately 40 hours per week.

The position offers hybrid schedule flexibility, conditional upon satisfactory completion of the 90-day onboarding period and ongoing business needs.

Due to court schedules, client requirements, deadlines, and the nature of litigation, the position may occasionally require extended hours or flexibility outside of the regular business schedule.
