Essential Duties and Responsibilities: include the following. Other duties may be assigned.
  • Manages a large portfolio of Contested Foreclosure Cases.
  • Develops strategy with contested specialists, foreclosure counsel and Clients to resolve contested foreclosure matters.
  • Manage team of direct reports providing staff with regular performance feedback on established metrics via scorecards and other forms of communication.
  • Manage escalated Title Curative matters, including filing title insurance claims when necessary.
  • Manage escalated lien priority claims including HOA, co-op, and municipal lien issues.
  • Manage escalated matters related to property preservation and upkeep, including takings, receivership appointments, and fines.
  • Notify SVP of high-risk matters upon intake (lien loss risk, class action risk, A Full-Service Residential Mortgage Loan Servicer Company named, etc.).
  • Understands mortgage loan servicing and the default, foreclosure, bankruptcy and loss mitigation processes as well as mortgage-related foreclosure matters such as contested foreclosures, statute of limitations issues, and affirmative defenses to foreclosure.
  • Reviews LPS queues to determine whether a case should be transferred to the Legal (Contested) Department.
  • Handles initial case intake and set up,
  • Ensures that investor reports are provided in advance of regular investor calls and facilitates meaningful substantive discussion on investor calls.
  • Responsible for management of cases to conclusion through judgment, trial, settlement or loss mitigation options.
  • Analyze industry case decisions and potential impact on A Full-Service Residential Mortgage Loan Servicer Company operations and clients.
  • Schedule trainings for the team with internal resources and outside firms.
  • Works with Default Case Managers, Legal Department, Loan Resolution Department, local counsel and investors to resolve contested foreclosure matters.
  • Responds to discovery requests and motions.
  • Conducts and finalizes factual research and analysis of loan issues.
  • Manages case dockets, deadlines and pleadings.
  • Participates in conference calls with investors and internal management to provide updates on assigned cases.
  • Participates in settlement negotiations in order to bring cases to resolution and minimize company risk and investor losses.
  • Provide coaching, training, and development to staff to ensure company and department goals and key performance indicators (KPIs) are met.
  • Recognizes and recommends operational improvements.
  • Develop and maintains department policies and procedures related to contested foreclosures.
  • Measure and document staff performance, attendance and compliance with job duties, expectations, regulations, guidelines, policies, and procedures.
  • Escalates issues to Management when necessary to ensure quality service.

  • Juris Doctor from an accredited law school.
  • Active license to practice law in at least one jurisdiction.
  • Ability to manage a large docket of cases.
  • Foreclosure law firm or prior consumer finance in-house foreclosure experience preferred.
  • Understands mortgage loan servicing and the default, foreclosure, bankruptcy, and loss mitigation processes.
  • Excellent attention to detail.
