Our firm is REMOTELY involved in trying cases across the State of California. That means as our Litigation Attorney, you will try the case predominantly through Zoom or other similar platforms. You may be required to attend various types of hearings or meetings in person from time to time.

Litigation Attorney Requirements:
  • California State Bar Admissions
  • Superior Knowledge of Procedural Law
  • Superior Knowledge of Special Education (minimum of three years working in special education or a closely related field)
  • Self-Starter
  • Strong Research, Written, Verbal Communication and Negotiation Skills
  • Experience Drafting Civil Complaints, Complex Pleadings, Demand Letters, Motions
  • Organized, Detail Oriented, and Ability to Multi-Task
  • Works Well under Pressure and Deadlines
  • Takes Initiative while Working Independently and also Work as Part of a Team
  • Effectively Interact with Clients and Coworkers Professionally and Efficiently

Litigation Attorney Responsibilites:

  • Maintain CA state bar license, ensuring compliance with MCLEs and updated contact information.
  • Directly represent parents and students with disabilities through the administrative process, including resolution sessions, mediations, and pretrial conferences.
  • Manage a caseload independently, including, client interviews, gathering evidence, preparing legal documents, and advising clients.
  • Investigate legal issues related to special education/disability rights, analyze case law, and develop legal strategies to support client's case.
  • Communicates directly with clients and opposing counsel.
  • Attends IEP meetings when relevant and necessary for representation.
  • Negotiates settlements and provides primary representation through mediation.
  • Bill a minimum of 1,500 hours per calendar year.
  • Conducts due process hearings independently (preparation of evidence, witnesses, conducting the hearing, and preparing the closing brief).
  • Litigates appeals with support from partners (drafts pleadings, engages in oral arguments, etc.).
