About the role:We are seeking an experienced Attorney to represent and advocate for individuals and business owners facing SBA loan defaults and other distressed debt situations. The ideal candidate will have substantial experience helping business navigate SBA loan defaults, collections, Treasury referrals, Offer in Compromise submissions, loan workouts, settlements, foreclosures, and related debt resolution matters.
This role focuses on protecting client interests, negotiating favorable outcomes, and guiding borrowers through complex financial and legal challenges.
Key Responsibilities:
- Represent borrowers and guarantors facing SBA loan defaults and collection actions.
- Advise clients regarding SBA 7(a), SBA EIDL, SBA 504, and other commercial loan obligations.
- Prepare and negotiate SBA Offers in Compromise (OICs).
- Develop customized debt resolution and settlement strategies.
- Negotiate directly with lenders, loan servicers, collection agencies, the SBA, and the U.S. Treasury.
- Assist clients with loan workout agreements, modifications, restructurings, and repayment plans.
- Counsel clients regarding personal guaranties and liability exposure.
- Represent clients in foreclosure, collection, judgment enforcement, and related proceedings.
- Collaborate with financial advisors, accountants, and consultants to support client resolutions.
- Analyze financial records and prepare supporting documentation for settlement and hardship requests.
- Stay current on SBA regulations, collection procedures, and borrower relief options.
Required Qualifications:
- Juris Doctor (JD) from an accredited law school.
- Active license to practice law in Michigan
- Minimum 5+ years of experience representing borrowers in SBA default, commercial debt, bankruptcy, creditor-debtor, or loan workout matters.
- Demonstrated experience with:
- SBA loan defaults
- SBA Offers in Compromise (OIC)
- Commercial debt settlements
- Loan modifications and workouts
- Foreclosure defense
- Collection defense
- Personal guaranty liability matters
- Bankruptcy and insolvency issues
- Strong negotiation and client advocacy skills.
- Excellent written and verbal communication abilities.
Preferred Qualifications:
Extensive SBA-specific experience, particularly involving:
- SBA 7(a) loans
- EIDL loans
- SBA 504 loans
- Treasury collections
- Wage garnishment and federal offset issues
- Experience working with entrepreneurs, small business owners, and professional service firms.
- Background in debt resolution, restructuring, or financial hardship matters.
