Position Summary:
Works independently to analyze complex legal issues in the property and casualty insurance space and in so doing anticipates unintended consequences and unasked but essential questions and addresses both. Represents the Legal Division in supporting APCIA's policy and government relations divisions in the development of public policy positions as well legislative and regulatory advocacy efforts. Specifically regarding regulatory rule-making, the AVP determines at the outset of the rule-making process whether authority exists for the proposed rule or regulation and actively engages as an APCIA comment drafter on the question. Throughout the rule-making process, the AVP ensures that the administrative record can support any litigation to challenge the regulator's authority that may be subsequently authorized. Direct litigation is a tool of last resort; however when it is contemplated or authorized, the AVP is key staff in managing assigned litigation or elements thereof (e.g., development of a related legal memo and draft complaint), including managing outside counsel and subject matter experts, to ensure litigation is warranted and if authorized to ensure it expeditiously moves forward to a successful conclusion while actively managing related costs. The AVP is one of four experienced trial lawyers within the Legal Division who can independently engage in the regulatory rule-making process and any litigation that arises therefrom and who has the industry experience to provide senior-level support to APCIA's policy and government relations divisions and member companies. In addition, the AVP independently delivers content support, counsel, and compliance (including antitrust) services for assigned policy committee staff, their policy committees, and state government relations managers. Continuously seeks to identify emerging issues arising out of inter-departmental interactions; member company feedback; and from reading industry-related periodicals, media, and court cases. Works with the VP Associate General Counsel (and the General Counsel as needed) to incorporate emerging issues identified into the AVP and Division portfolios as appropriate.

Position Qualifications/Education
Qualifications:
  • Education:
    • Law degree from an ABA-accredited law school.
    • Good standing in the state bar association where the applicant/incumbent lives and works.
  • Experience:
    • Twelve years' of litigation experience (at least 5 years of which includes in-house management of outside counsel) in the defense of property or casualty claims and/or coverage.
    • Thorough knowledge of the property and casualty insurance business, nonprofit/trade association law, in-house practice and compliance matters.
    • Strong legal research, writing, analytical, and critical thinking skills.
    • Strong verbal and written communications and the ability to present the results of research and recommendations to internal clients and members in a clear and concise way.
  • Required Skills and Abilities
  • Proficiency in interpreting and explaining case law, statutes, and regulations to others, including non-lawyers.
  • Proficiency in Office 365 applications, including SharePoint (or equivalent document sharing application) and One Drive
  • Preferences: (Extra weight given to the following):
    • Experience as an insurance regulator or dealing with regulators on behalf of an insurance entity.
