The Assistant General Counsel, Patent Litigation role is responsible for actively developing and executing patent litigation strategy across a broad and diverse international intellectual property and product/technology portfolio, including focusing on United States and European patent litigation while working within a global matrixed structure to input into global patent disputes and strategies.The expectation for this role is to proactively set and drive litigation strategy, including leading and supervising external counsel. This role is also responsible for avoiding litigation and other disputes, through preventative and pragmatic legal advice, identification of potential risk areas, and driving early resolution of disputes/claims when necessary. The position will report directly to VP, Intellectual Property, Head of Patent Litigation.
Key Responsibilities:
- Lead highly complex and significantly impactful patent enforcement initiatives.
- Develop and execute litigation strategy across various jurisdictions, with a focus on the United States and Europe.
- Represent GSK at meetings, hearings, and trials.
- Effectively manage numerous competing priorities and perform at a high level in a continually changing global legal, regulatory, and scientific environment, including providing input and strategy into foreign proceedings, such as European Patent Office, United Kingdom, German and Unified Patent Court proceedings.
- Interface with company at all levels, including General Counsel and other senior business and legal employees.
- Communicate effectively and build teamwork among company employees involved in enforcement and defense of critical GSK intellectual property, including driving key learnings back into the department
- Work very closely with external counsel and internal stakeholders to develop and drive overall litigation strategy, including worldwide litigation strategies, ensure compliance with company policies, and drive cost savings.
- Demonstrate capacity for innovation in providing unique and creative solutions to complex legal issues.
- Drive AI solutions to deliver AI initiatives, including those related to litigation management and outcomes.
Why you?
Basic Qualifications:
We are looking for professionals with these required skills to achieve our goals:
- Qualified U.S. attorney, JD degree required
- 8+ years of significant experience with complex patent litigation in the biotechnology and/ or pharmaceutical industries.
- Major U.S. law firm and/or large corporate litigation department experience
- Demonstrated experience with international IP litigations
Preferred Qualifications:
If you have the following characteristics, it would be a plus:
- Extensive hands-on experience with all aspects of U.S. patent litigation, including fact and expert discovery (witness and report preparation), as well as in-court experience from motion practice to bench and jury trials. Having experience arguing to the court a significant plus.
- An advanced scientific degree and registered to practice before the United States Patent and Trademark Office a significant plus.
- Ability to work in a highly team-oriented environment a strong plus
- Creative and strategic approach to the development and enforcement of IP
- Ability to communicate competently and confidently with senior management.
