The New Mexico Aging and Long-Term Services Department's (ALTSD) overarching goal and mission is that New Mexico's older adults, adults with disabilities, and caregivers have the right to remain active participants in their communities, to age with respect and dignity, to be protected from abuse, neglect, and exploitation and to have equal access to health care and social supports.

The Office of the General Counsel provides legal representation to ALTSD's Office of the Secretary, Office of Indian Elder Affairs and five divisions: Adult Protective Services, Administrative Services, the Aging Network, Consumer and Elder Rights, and Long-Term Care.

Why Does the Job Exist?

To Provide Legal Representation to The Aging and Long-Term Services Department.
How Does It Get Done?
The Assistant General Counsel Provides Comprehensive Legal Services to The Office of The Secretary and All Altsd Divisions as Assigned by The General Counsel. This Would Include the Following Responsibilities:
  • Provide Advice to The Office of The Secretary, Altsd Senior Management, and Staff Regarding Complex Legal and Management Issues. Advice Is Provided in The Context of Formal and Informal Meetings, Which May Be Conducted in Person, Over the Phone, or By Video Conference. the Assistant General Counsel Will Also Be Expected to Provide Advice by Written Memorandum.
  • Prepare Legal Documents, Including Letters, Pleadings, Reports, Memorandums, Department Rules, Department Policies, and Other Legal Documents as Assigned.
  • Review Contracts, Memorandums of Understanding, Intergovernmental Agreements, and Capital Outlay Grant Agreements.
  • Review Disciplinary Actions and Corresponding Notices in Collaboration with The Office of The Secretary, Senior Management, and The Human Resources Department.
  • Advise that Agency on Federal and State Law Requirements, Such as The Americans with Disabilities Act, Family and Medical Leave Act, Inspection of Public Records Act, and The New Mexico Tort Claims Act.
  • Consult with New Mexico's Risk Management Division on Pending Litigation.
  • Advise and Assist the Adult Protective Services Division in Support of Its Mission to Protect Adults from Abuse, Neglect, and Exploitation.
  • Represent the Agency at State Personnel Board Hearings.
  • Any Other Duties as Assigned by The General Counsel.

Ideal Candidate:
  • Ability to Offer Conflict-Free Legal Counsel, Guidance, and Memorandums to Assist the Department in The Performance of The Official Duties of The Office of The Secretary, Office of Indian Elder Affairs, and Five Agency Divisions.
  • Ability to Draft, Review, and Evaluate Legal Documents.
  • Excellent Legal Research and Writing Skills.
  • Ability to Communicate Effectively and Provide Competent, Concise Legal Advice to A Variety of Clients.
  • The Ideal Candidate Must Be Professional, Courteous, Civil, Respectful, and Must Provide Open, Honest and Thorough Communication.

Minimum Qualification:
Juris Doctorate Degree from An Accredited School of Law. Must Be Licensed as An Attorney by The Supreme Court of New Mexico or Qualified to Apply for Limited Practice License.

Employment Requirements:
All Attorney Classifications Must Be and Remain Licensed as An Attorney, in Good Standing, by The Supreme Court of New Mexico, or Licensed as An Attorney and In Good Standing by The Highest Court of Another State and Eligible Pursuant to The Limited License Provisions (see Rules 15-301.1 and 15-301.2 Nmra).

Must Possess and Maintain a Valid Driver's License. Must Possess and Maintain a Current Defensive Driving Course Certificate from The State of New Mexico or Must Pass and Receive Defensive Driving Course Certification Within 90 Days of Employment.

Working Conditions:
Work Is Performed in An Office Setting: Late Hours, Weekends, On-Call and Callback Work May Be Required. Will Be Exposed to Regular Periods of Video Display Terminal and Keyboard Usage and Stressful Situations. Travel Is Required. Possible Exposure to Irate Clientele. Incumbent Will Work Under Stress and Frequent Time Constraints.
