Description of Work:
We're hiring for an Assistant General Counsel to join our amazing General Counsel Office within the NC Department of Adult Correction. This position is intended to support primarily, though not exclusively, the Division of Prisons, Division of Health Services, and other divisions or sections as needed.

This position reports to a Deputy General Counsel and will provide the following legal services:
  • Work collaboratively with the North Carolina Attorney General's Office, especially the Public Safety Section, to provide guidance as necessary or as requested regarding statutes, policies, and rules applicable to correctional and medical issues and related litigation;
  • Serve as a liaison between DAC and the Attorney General's Office;
  • Assist with policy development and the legal review of proposed policy documents, standard operating procedures (SOP's) and other documents;
  • Provide assistance with drafting, revising, and evaluating legal instruments, including contracts, memoranda of understanding, statutes or legislative proposals, and settlement agreements;
  • Provide other legal advice and assistance to Department administration, management, and staff as needed.

This position ordinarily works forty hours a week, 8:00 am until 5:00 pm, Monday thru Friday. Additional work hours may be required to meet daily priorities and to accomplish division and department missions. The work schedule often extends beyond the eight-hour day, particularly during the legislative session, due to unanticipated demands requiring significant schedule changes.

The employee is expected to work independently with periodic general review from the supervisor. The employee must use good judgment, demonstrate initiative, and exercise discretion in dealing with sensitive or confidential issues or information. Complex or controversial problems are discussed with the supervisor on an as-needed basis. The supervisor provides verbal guidance and conducts annual performance reviews. Supervision is also received through review of reports and discussions as to the status of assignments.

The O?ce of General Counsel (OGC) provides to executive and administrative management oral and written legal opinions on laws, constitutional provisions, administrative rules and regulations, court decisions, and other precedents impacting DAC's policies, procedures, and operations. This section drafts and reviews departmental rules and regulations, operational guidelines, contracts, department-sponsored legislation, and other legal documents. Attorneys in the OGC provide oral and written responses to inquiries by federal, state, and local o?cials including legislators, judicial o?cials, law enforcement personnel, and citizens about the department's policies and practices and the statutes and regulations it enforces. The OGC provides timely and accurate legal advice on a wide variety of relevant topics to executive staff and staff in the field. The office also works closely with trial counsel at the North Carolina Department of Justice on all litigation involving the Department.

  • Licensed to Practice Law in North Carolina
  • A strong desire to work in state government
  • Demonstrated ability to work independently, establish priorities and meet deadlines in response to work flow
  • Personal interest in researching and addressing a multitude of legal issues related to the Department
  • Ability to maintain effective working relationships with Department managers, the public and other persons contacted in the course of work
