Job Description:This position is focused on regulatory and compliance matters, in support of MOHELA and its affiliates. In particular, the role involves providing guidance on:
- Federal, state, and local consumer protection laws and regulations, including ECOA, TILA, FCRA, UDAAP, SCRA/MLA, TCPA, NACHA, Regulation E, GLBA, CAN-SPAM;
- State and local student loan servicing and collections laws;
- Federal student loan laws and regulations, and well as corresponding federal contract requirements; and
- Federal, state, and local privacy laws.
Essential Duties and Responsibilities:
- Stay apprised of laws, regulations, guidance, and case law concerning MOHELA's – as well as its affiliates' – core business areas. In particular, this includes matters such as consumer lending, student loan servicing, and collections, as well as privacy.
- Provide clear, timely, and actionable legal counsel and advice to senior compliance and business partners that advance business goals while addressing and mitigating regulatory risks.
- Perform legal review of consumer-facing policies, notices, disclosures, consumer-facing correspondence, and other documents and materials, as well as product flows, marketing collateral.
- Facilitate, from a legal perspective, large-scale regulatory projects.
- Generally, work with compliance and business partners to ensure a controlled and compliant environment through the remediation of root-cause issues identified in audits, litigation, compliance testing and monitoring, complaint handling, threatened litigation, and government inquiries or regulatory examinations.
- Coordinate with the Federal Contracts team, and other departments, on the implementation of change requests and other guidance issued by the federal government.
- Help set company-wide expectations, including the importance of developing and adhering to robust processes and controls, to mitigate risk/exposure.
- Other projects as directed by the General Counsel.
- Recognizes points of connectivity and collaborates across business, compliance, and legal teams. Proactively brings those teams together and drives efficient legal and business outcomes.
- Track and support implementation of new state or federal privacy legislation and provide legal support for privacy and data security matters.
Minimum Requirements:
- Doctor of Jurisprudence from a nationally accredited law school and a current member in good standing in at least one state bar.
- Licensed, eligible to practice law in Missouri or the ability to obtain admission to the MO state bar in a timely manner.
- At least 12 years of experience with a law firm, in-house legal department, and/or governmental agency.
- At least 6 or more years of experience with an emphasis on consumer protection related matters.
- Strong knowledge of federal and state consumer lending and privacy laws and regulations, including: ECOA, TILA, FCRA, UDAAP, SCRA/MLA, TCPA, NACHA, Regulation E, GLBA, CAN-SPAM, and state consumer protection laws.
- This is a hybrid position. Candidates must live within 1 hour of our Chesterfield, MO location and will be expected to work onsite 2-3 days per week.
- Must be a U.S. citizen with an active 6C Public Trust Security Clearance or the ability to obtain this level of clearance.
- Some travel may be required.
Engagement with regulatory agencies and ability to assist with, and in some cases coordinate responses to regulatory requests.
- Ability to quickly grasp and understand complex business practices, products and services, and operations, and competently interpret and explain the law and legal requirements given the operations and business environment and, consequently, helping the business assess risk and proposing risk mitigation options.
- Ability to understand and then clearly communicate verbally and in writing complex legal and business concepts to others, including employees and managers in compliance, legal and operations.
- Ability to make professional legal and business presentations in writing, through emails and reports, or orally, including complex legal, business, and technical matters to an audience of high technical skills, management, and operational experience.
- Ability to partner with others to achieve objectives, including implementing updates to policy and processes.
- Strong legal/financial/business acumen and ability to work effectively and multitask successfully in fast-paced and complex business environment.
- Ability to work beyond regularly scheduled business hours; travel may be required locally or to other business locations, or to manage legal matters.
- Ability to effectively supervise outside attorneys when directed by the General Counsel or senior attorneys.
- Hard-working self-starter with excellent attention to detail, thrives in a fast-paced, energetic environment, and has excellent problem solving, interpersonal, teamwork, writing, negotiation, and client communication skills.

Preferred Qualifications:
- Experience with the student loan industry or consumer loan servicing industry.
- Experience ensuring compliance with federal contracting requirements.
- Experience with change management efforts.
