Job Summary:
Located in the nation's capital, the Office of the Attorney General (OAG) is the chief legal office of the District of Columbia. OAG enforces the District's laws, works to protect, and defend D.C. residents, and provides the highest level of independent legal advice and guidance to District of Columbia government agencies. The Civil Litigation Division of the Office of the Attorney General for the District of Columbia is seeking a Trial Attorney for the Civil Enforcement Section.

The Civil Enforcement Section is responsible for affirmative litigation and prosecutions that support enforcement of the District's laws and regulations. The Enforcement Section defends litigation involving administrative appeals of final District agency actions to the Superior Court of the District of Columbia and to the District of Columbia's Office of Administrative Hearings. The Section also recovers funds to satisfy Medicaid liens filed by the District of Columbia Department of Health Care Finance (DHCF), prosecutes civil forfeiture matters, and brings the District's subrogation lawsuits.

Duties and Responsibilities:
Trial Attorney, LA-0905-12
The Office of the Attorney General for the District of Columbia seeks a Trial Attorney for the Civil Enforcement Section of the Civil Litigation Division.

The successful candidate will primarily be responsible for the enforcement of the Health Care Assistance Reimbursement Act, D.C. Code 4-601 et seq. Specifically, the attorney will review medical claim details, draft Medicaid liens for filing with the Recorder of Deeds, analyze Medicaid lien compromise requests for consideration by DHCF, and collect payments to satisfy the Medicaid liens filed by OAG. In probate matters governed by D.C. Code 20-301 et seq., the attorney will petition the Probate Division of the Superior Court of the District of Columbia to become the personal representative of a decedent's estate, when warranted, to collect payments to satisfy the Medicaid liens filed by DHCF, and take any other action authorized by the statute to ensure that Medicaid liens are satisfied. The candidate will also handle civil enforcement litigation matters and administrative prosecutions brought before various administrative tribunals including the Alcoholic Beverage and Cannabis Board, OAH, various DC Health professional boards, and the Superior Court of the District of Columbia to protect the public welfare. The candidate will file pleadings, administrative charging documents and motions, conduct discovery including depositions, procure experts, and conduct trials and evidentiary hearings. The incumbent must possess the ability to receive and implement feedback.

Qualifications and Education:
Trial Attorney, LA-0905-12
Incumbent must have a Juris Doctor (J.D.) from an American Bar Association (ABA) accredited law school at the time of appointment. A minimum of 1 year of specialized experience is required.

License and Certification:
The incumbent must be an active member in good standing of the District of Columbia Bar or have the ability to waive in and be admitted within 360 days of appointment. An appointee to the Legal Service shall remain a member in good standing of the District of Columbia Bar and be admitted to practice in the U.S. District Court for the District of Columbia during his/her employment in the Legal Service. If not currently a member of the District of the Columbia Bar, prior to appointment, the successful candidate must send proof that his/her completed District of Columbia Bar application has been submitted to the District of Columbia Bar.

Working Conditions/Environment:
Work is primarily performed in an office setting. Generally, work is sedentary, some walking, handling, and carrying of light to moderately heavy objects (such as case records, briefcases, and exhibits) is required.

Salary: The starting salary for this position is negotiable up to $100,172 depending on qualifications and availability of funds.
