Introduction:
This position is in A Government Entity. The mission of the HBX is to implement a health care exchange program in the District of Columbia in accordance with the Patient Protection and Affordable Care Act (PPACA), and the Health Benefit Exchange Authority Establishment Act of 2012, thereby ensuring access to quality and affordable health care to all District of Columbia residents.

Duties:
The Associate General Counsel and Policy Advisor serves as Privacy and Security Officer to HBX, coordinates reporting and mitigation of privacy incidents and breaches, and provides legal guidance to HBX IT, Exchange Operations, Communications and Other Groups regarding privacy and security requirements for Exchanges and DC Government entities. Relevant legal authorities for this position include but are not limited to: CMS Regulations for privacy and security of personally identifiable information and use of standards and protocols for electronic transactions (45 C.F.R. 155.260 and 155.270), CMS Minimum Acceptable Risk Standards for Exchanges (MARS-E), IRS Code Section 6103 and Publication 1075, and the federal Privacy Act of 1974.

The position involves work on topics related to IT and cybersecurity including data inventory management and Artificial Intelligence, as well as general topics related to federal regulatory compliance for Exchanges.

The position may involve HBX regulatory and policy projects, such as conducting legal research for HBX leadership or drafting comments or testimony in support of federal rulemaking or District legislation related to health care or the insurance marketplace.

The position involves a maximum amount of direct client contact with multiple staff roles (including, in some circumstances, HBX leadership). The position also involves occasional to moderate interaction with HBX customers and with representatives of other entities (e.g., federal oversight agencies, District agencies, non-exchange entity partners). Accordingly, the position requires strong organizational skills, cross-cultural competency, and ability to build effective working relationships within and outside of HBX.

Special Requirements:
Must have a law degree and be a member of the District of Columbia Bar or eligible for waiver into the Bar.

At least five (5) years of health insurance experience is preferred. Federal, state, or municipal level insurance regulatory experience is desirable.
