Duties Summary:
The function of the organizational unit is to monitor and enforce the activities of individuals and entities not in compliance with the Uniform Securities Act, Chapters 485, 485A, Hawaii Revised Statutes (HRS), and the Franchise Investment Law, Chapter 482E, HRS.
The position provides legal services in the investigation and prosecution of securities law and franchise law violations. The primary function of the position is to institute legal action against registrants and non-registered entities and individuals under Chapters 485, 485A and 482E, HRS.
Minimum Qualification Requirements:
- Education: Juris doctorate from an accredited law school.
- Experience: Three (3) years of legal experience as a licensed attorney.
- Knowledge: Possess knowledge of financial transactions and accounting principles. General knowledge of the applicable Federal and State Securities Laws, Chapter 485A and their related Rules and Regulations; the Franchise Investment Law, Chapter 482E, HRS and its related Rules and Regulations; the Hawaii Administrative Rules (Department of Commerce and Consumer Affairs) on Administrative Practice and Procedure; the policies and procedures of the North American Securities Administrators Association, Inc.; the FINRA's Rules of Conduct and other Self-Regulatory Organizations.
- Skills/ Abilities: Ability to analyze and interpret business related documents including, but not limited to financial statements and bank statements. Review of investigations being conducted and assisting in any follow-up investigation. Research statutes, regulations, case law and resource materials in determining action to be taken in relation to any violations of the securities laws or franchise laws. Ability to negotiate settlements and to prosecute civil and administrative actions before an administrative hearings officer or judge in circuit court. Conducts the trial or hearing on matters, including the preparation. Ability to meet and deal effectively with other employees of the Department, other agencies, as well as the public as required, including participating in investor protection education presentations.
- Requirement: Licensed to practice law in the State of Hawaii.

This position is exempt from the civil service and considered temporary in nature. Therefore, if you are appointed to the position, your employment will be considered to be "at will," which means that you may be discharged from your employment from the department head or designee at any time.
