Duties Summary:
The incumbent in this position will be responsible for providing legal services in the investigation and prosecution of securities law and franchise law violations. The primary function of the position is to institute legal action against registrants and non-registered entities and individuals under Chapters 485 and 482E, Hawaii Revised Statutes.
Minimum Qualification Requirements:
Education: Graduation from an accredited law school with a Juris Doctor degree.
Experience: Three (3) years of legal experience as a licensed attorney.
Knowledge: Financial transactions and accounting principles; Federal and State Securities Laws and their related Rules and Regulations; Franchise Investment Law, Chapter 482E, Hawaii Revised Statutes and its related Rules and Regulations; Hawaii Administrative Rules (Department of Commerce and Consumer Affairs) on Administrative Practice and Procedure; policies and procedures of the North American Securities Administrators Association, Inc.; FINRA's Rules of Conduct and other Self-Regulatory Organizations.
Skills/Abilities: Analyze and interpret business related documents including, but not limited to, financial statements and bank statements; review investigations being conducted and assist in any follow up investigation; research statutes, regulations, case law and resource materials in determining action to be taken in relation to any violations of the securities laws or franchise laws; negotiate settlements and to prosecute civil and administrative actions before an administrative hearings officer or judge in circuit court; conduct trial or hearings on matters, including the preparation; meet and deal effectively with other employees of the Department, other agencies, as well as the public as required; participate in investor protection education presentations.
Requirement: Licensed to practice law in the State of Hawaii.
