The position is located on Oahu (Downtown Honolulu).

Duties Summary:
The function of this organizational unit is to provide legal advice and assistance to the Insurance Division, which regulates the insurance industry, mutual benefit societies and health maintenance organizations. The legal staff answers legal inquires from the Insurance Commissioner ("Commissioner"), staff, insurers, insurance agents and the general public regarding the Insurance Code, administrative rules and court decisions.

The purpose of this position is to research and interpret statutory provisions and case law and request for Attorney General opinions if necessary. Draft legislation, administrative rules and hearing decisions, correspondence to insurers, insurance agents and the general public. Advise the Insurance Division and/or Attorney General in preparing for administrative or disciplinary proceedings. Act as a hearing officer for administrative or disciplinary proceedings.

Minimum Qualification Requirements:
Education: Graduation from an accredited law school with a Juris Doctor degree.

Experience: Preferred experience in or with the insurance industry, e.g., having an agent's license, worked as counsel for an insurance company, State Insurance Department, or practiced insurance defense work. The required work experience is an attorney who practiced law for a minimum of five years, of which at least two years is in litigation, preferably in an insurance related area.

Knowledge: Understanding of insurance terms and concepts such as motor vehicle insurance, life insurance, property & casualty insurance, annuities, reinsurance and indemnity. Understanding of general legal principles, and statutory and case law.

Skills/Abilities: Ability to research substantive legal issues and provides interpretation of statutes to the Commissioner and the Insurance Division staff. Good oral and written communication skills. Ability to write testimony for legislative hearings, draft legislation, draft new regulations and amend existing regulations. Have the ability to conduct administrative hearings or represent the Insurance Division at administrative hearings. Computer literacy. Proficient in and/or ability to learn how to use and apply software for word processing word processing, spreadsheet, database, e-mail, Windows and internet.

Requirement: Licensed to practice law in the State of Hawaii.

This position is exempt from the civil service and considered temporary in nature. Therefore, if you are appointed to the position, your employment will be considered to be "at will," which means that you may be discharged from your employment from the department head or designee at any time.
